لا يجوز لدولة خلف ليست من الدول المستقلة حديثاً، تكون معاهدة نافذة إزاءها عقب خلافة للدول، أن تصوغ اعتراضاً على تحفظ لم تعترض عليه الدولة السلف، إلا إذا كانت مهلة صوغ الاعتراض لم تنقض قبل تاريخ خلافة الدول وإذا صيغ الاعتراض في حدود هذه المهلة.

2.3.2 Time period for formulating an objection to a reservation that is formulated late

It goes without saying that the freedom to formulate an objection must be exercised in accordance with the provisions of the Guide to Practice - a point so self-evident that the Commission did not think it was worthwhile to mention it in the text of guideline 2.6.3.

It does state that the time period during which the objection may be formulated commences when the reservation is notified to the State or international organization that intends to make an objection, in accordance with guideline 2.1.6, which implies that the objection may be formulated as from that date.
ولا شك أنه يوضح أن المهلة التي يجوز صوغ الاعتراض خلالها تبدأ منذ تاريخ إبلاغ التحفظ إلى الدولة أو المنظمة الدولية التي تعتزم إبداء الاعتراض وفقاً للمبدأ التوجيهي 2-1-6، وهو ما يعني ضمناً أنه يمكن منذ هذه اللحظة الاعتراض على التحفظ.
