" 1. For the purposes of this Act, `crimes against humanity'means any of the following acts when knowingly committed as part of a widespread or systematic attack directed against any civilian population:
" أولاً- الجرائم ضد الإنسانية تعني لأغراض هذا القانون أياً من الأفعال المدرجة في أدناه متى ارتكبت في إطار هجوم واسع النطاق أو منهجي موجّه ضد أية مجموعة من السكان المدنيين وعن علم بهذا الهجوم:

Rome Statute of 17 July 1998 on the creation of the International Criminal Court (ICC), article 7 of which characterizes enforced disappearances, when committed as part of a widespread or systematic attack directed against any civilian population and with knowledge of the attack, as a crime against humanity.
:: نظام روما الأساسي المؤرخ 17 تموز/يوليه 1998 الذي أُنشئت بموجبه المحكمة الجنائية الدولية، والذي تصنف المادة 7 منه حالات الاختفاء القسري كجرائم ضد الإنسانية عندما ترتكب عنوة في سياق هجوم واسع النطاق أو منهجي ضد أية مجموعة من السكان المدنيين.

International law recognizes detention or other severe deprivation of physical liberty as a crime against humanity, where it is committed as part of a widespread or systematic attack against any civilian population.
ويعتبر القانون الدولي الاحتجاز أو الحرمان الشديد على أي نحو آخر من الحرية البدنية جريمة ضد الإنسانية، متى ارتكب في إطار هجوم واسع النطاق أو منهجي موجه ضد أية مجموعة من السكان المدنيين().

This definition includes several criteria: " For the purposes of this present Statute `crimes against humanity'means [any of the following] acts where committed as part of a widespread or systematic attack directed against any civilian population, with knowledge of the attack. "
ويشمل هذا التعريف عدة معايير: " لغرض هذا النظام الأساسي، يشكل أي فعل من الأفعال التالية جريمة ضد الإنسانية متى ارتكب في إطار هجوم واسع النطاق أو منهجي موجه ضد أية مجموعة من السكان المدنيين وعن علم بالهجوم " .

The statute of the International Tribunal for the former Yugoslavia, which the Security Council adopted by its resolution 827 (1993), gives the Tribunal the power to prosecute persons responsible for rape when committed in armed conflict, whether international or internal in character, and directed against any civilian population.
ويعطي النظام الأساسي للمحكمة الجنائية الدولية ليوغوسلافيا السابقة، الذي اعتمده مجلس الأمن بقراره 827 (1993)، للمحكمة سلطة محاكمة الأشخاص المسؤولين عن الاغتصاب عندما يرتكب في النزاعات المسلحة، سواء كانت هذه النزاعات دولية أو داخلية الطابع، وحينما يكون موجها ضد أية مجموعة من السكان المدنيين.

Article 6 (c) of the Charter of the International Military Tribunal and article 5 of the Charter of the Tokyo Tribunal define crimes against humanity as murder, extermination, enslavement, deportation and other inhumane acts committed against any civilian population before or during the war.
٩٩ - وتعرف المادة ٦)ج( من ميثاق المحكمة العسكرية الدولية والمادة ٥ من ميثاق محكمة طوكيو الجرائم المرتكبة ضد الانسانية بأنها جرائم القتل العمد، واﻹبادة، والاسترقاق، والابعاد، وغير ذلك من اﻷفعال اللاإنسانية التي تُرتكب ضد أية مجموعة من السكان المدنيين قبل الحرب أو خلالها.

" (a) `Attack directed against any civilian population'means a course of conduct involving the multiple commission of acts referred to in paragraph 1 of this article against any civilian population, pursuant to or in furtherance of a state or organizational policy to commit such attack;
(أ) هجوم موجّه ضد أية مجموعة من السكان المدنيين يعني نهجاً سلوكياً تضمن الارتكاب المتكرر للأفعال المنصوص عليها في البند أولاً من هذه المادة ضد أية مجموعة من السكان المدنيين عملاً بسياسة دولة أو منظمة تقضي بارتكاب مثل هذا الهجوم، أو تعزيزاً لهذه السياسة؛

" This attack constitutes a course of conduct involving the multiple commission of acts referred to in article 7, paragraph 1, against any civilian population, pursuant to or in furtherance of a State or organizational policy to commit such attack " .
" 3 - تعني عبارة " هجوم موجه ضد أية مجموعة من السكان المدنيين " نهجا سلوكيا يتضمن الارتكاب المتكرر للأفعال المشار إليها في الفقرة 1 ضد أية مجموعة من السكان المدنيين، عملا بسياسة دولة أو منظمة تقضي بارتكاب هذا الهجوم، أو تعزيزا لهذه السياسة " .

(a) " Attack directed against any civilian population " means a course of conduct involving the multiple commission of acts referred to in paragraph 1 against any civilian population, pursuant to or in furtherance of a State or organizational policy to commit such attack;
(أ) تعني عبارة " هجوم موجه ضد أية مجموعة من السكان المدنيين " نهجا سلوكيا يتضمن الارتكاب المتكرر للأفعال المشار إليها في الفقرة 1 ضد أية مجموعة من السكان المدنيين، عملا بسياسة دولة أو منظمة تقضي بارتكاب هذا الهجوم، أو تعزيزا لهذه السياسة؛

11. These same elements are repeated in article 7 (1) of the Statute of the International Criminal Court which states: " For the purpose of this Statute, `crime against humanity'means any of the following acts when committed as part of a widespread or systematic attack directed against any civilian population, with knowledge of the attack. "
11- وتكررت هذه العناصر نفسها في المادة 7(1) من النظام الأساسي للمحكمة الجنائية الدولية الذي ينص على أنه: " لغرض هذا النظام الأساسي، يشكل أي فعل من الأفعال التالية `جريمة ضد الإنسانية` متى ارتكب في إطار هجوم واسع النطاق أو منهجي موجه ضد أية مجموعة من السكان المدنيين وعن علم بالهجوم " .

An “attack directed against any civilian population” has been defined as “... a course of conduct involving the multiple commission of acts ... against any civilian population, pursuant to or in furtherance of a State or organizational policy to commit such attack” (art. 7 (2) (a)).
وقد عُرﱢفت عبارة " هجوم موجه ضد أية مجموعة من السكان المدنيين " بأنها تعني " نهجا سلوكيا يتضمن الارتكاب المتكرر لﻷفعال... ضد أية مجموعة من السكان المدنيين، عملا بسياسة دولة أو منظمة تقضي بارتكاب هذا الهجوم، أو تعزيزا لهذه السياسة " )المادة ٧)٢()أ((.
