The Parliamentary Assembly of the Council of Europe joined this debate following a report by its Committee on Migration, Refugees and Demography of 27 February 2001, which described the expulsion of long-term immigrants convicted in criminal proceedings as being discriminatory, " because the state cannot use this procedure against its own nationals who have committed the same breach of the law " .

59. Pursuant to the request contained in paragraph 9 of resolution 63/119, the Office of Legal Affairs made a number of referrals whereby it brought credible allegations that reveal that a crime may have been committed by United Nations officials and experts on mission to the attention of the States against whose nationals such allegations had been made.

Sections V and VI of the report relate to activities undertaken within the Secretariat in the implementation of paragraphs 9 to 14 of the resolution, focusing in particular on information regarding the bringing of credible allegations that reveal that a crime may have been committed by United Nations officials or experts on mission to the attention of the States against whose nationals such allegations are made, and matters related thereto.

Referrals are made under General Assembly resolution 62/63, pursuant to which the Secretary-General has an obligation " to bring credible allegations that reveal that a crime may have been committed by United Nations officials and experts on mission to the attention of the States against whose nationals such allegations are made " .

A new phrase, " including referrals to appropriate authorities for prosecution and the procedures therefor " , had been included in paragraph 17, bearing in mind the importance of the request in paragraph 9 that the Secretary-General should bring credible allegations that a crime might have been committed by United Nations officials or experts on mission to the attention of the States against whose nationals such allegations were made.

The application of expulsion measures against them seems both disproportionate and discriminatory: disproportionate because it has lifelong consequences for the person concerned, often entailing separation from his/her family and enforced uprooting from his/her environment, and discriminatory because the state cannot use this procedure against its own nationals who have committed the same breach of the law. [...]
