The United Nations liability for property loss or damage in the ordinary operation of the force is recognized subject to the principle of “operational necessity”, within the parameters described above.

5. The present report comprises three parts: the first part describes the scope of United Nations liability for damage resulting from the ordinary operation of the Force, from “operational necessity” and combat-related damage.

92. While the Committee had recognized the need to refine the definition of “operational necessity”, it was widely acknowledged that, in paragraph 14 of his report (A/51/389), the Secretary-General had made an excellent attempt to define that term.

At the same time, as indicated in paragraph 13 of the report, the liability of the Organization for property loss and damage caused by United Nations forces in the ordinary operation of the force is subject to the exception of " operational necessity " , that is, where damage results from necessary actions taken by a peacekeeping force in the course of carrying out its operation in pursuance of its mandate.

8. The Advisory Committee welcomes the development of the concept of " operational necessity " which has been formally presented in a document for the first time, although it has already been applied in the practice of Claim Review Boards as an exception from liability.
٨ - واللجنة الاستشارية ترحب بتطوير مفهوم " ضرورات التشغيل " الذي قُدم رسميا في وثيقة للمرة اﻷولى، على الرغم من أنه قد وضع موضع التطبيق بالفعل في مجلس استعراض المطالبات كاستثناء من المسؤولية القانونية.

(e) The payment of compensation is excluded in the event of operational necessity.

13. The liability of the Organization for property loss and damage caused by United Nations forces in the ordinary operation of the force is subject to the exception of “operational necessity”, that is, where damage results from necessary actions taken by a peacekeeping force in the course of carrying out its operations in pursuance of its mandates.5
٣١- إن مسؤولية المنظمة عن فقد الممتلكات أو تلفها بسبب قوات اﻷمم المتحدة أثناء التشغيل العادي للقوة مرهونة باستثناء " ضرورات التشغيل " ، أي عندما يحدث الضرر نتيجة لﻷعمال الضرورية التي تقوم بها قوة حفظ السلام خلال تنفيذ عملياتها وفقا لولايتها)٥(.

6. Endorses the view of the Secretary-General that liability is not engaged in relation to third-party claims resulting from or attributable to the activities of members of peacekeeping operations arising from " operational necessity " , as described in paragraph 14 of the first report of the Secretary-General on third-party liability;A/51/389.
٦ - تؤيد رأي اﻷمين العام بأن المسؤولية لا تنشأ إزاء مطالبات المسؤولية قِبل الغير الناجمة عــن أو المنسوبة إلى أنشطة أفــراد عمليـات حفــظ الســلام المضطلع بها فــي إطار " ضرورات التشغيل " ، على النحو الموصوف في الفقرة ١٤ من التقرير اﻷول لﻷمين العام بشأن المسؤولية قِبل الغير)٥(؛

They include claims arising from: (a) personal injury, illness or death; (b) damage to property; and (c) non-consensual use of privately owned premises, unless such claims are precluded as a result of " operational necessity " .
وتشمل هذه الحدود المطالبات الناشئة عن (أ) الإصابة الشخصية أو المرض أو الوفاة؛ (ب) والإضرار بالممتلكات؛ (ج) واستعمال المباني الخاصة بدون موافقة مالكيها، ما لم تكن هذه المطالبات قد استثنيت بسبب " ضرورات التشغيل " .

Claims resulting from the operational necessity of a peacekeeping operation would thus be excluded from the scope of competence of the standing claims commissions in the following terms: “any dispute or claim of a private law character, not resulting from the operational necessity of the United Nations peacekeeping operation, to which the United Nations operation or any member thereof is a party”.
ولذلك فإن المطالبات الناشئة عن " ضرورات التشغيل " ﻷية عملية لحفظ السلام سوف تستبعد من نطاق صلاحية لجنة المطالبات الدائمة في حالة: " أية منازعة أو مطالبة لها طابع القانون الخاص، وليست ناشئة عن " ضرورات التشغيل " لعملية حفظ السلام لﻷمم المتحدة، وتكون عملية اﻷمم المتحدة لصيانة السلم أو أحد أفرادها طرفا فيها...
