The Convention should provide for appropriate security to be requested from the claimant who sought arrest in order to cover ordinary port dues and expenses.
وينبغي أن تنص الاتفاقية على ضمان مناسب يُطلب من المدﱠعى الذي يطلب الحجز لتغطية الرسوم والنفقات العادية للميناء.

(1) The arbitral tribunal may require the party requesting an interim measure to provide appropriate security in connection with the measure.

15. Pursuant to article VI of the Convention, the authority before which the award is sought to be relied upon may order that the party opposing enforcement give suitable security " on the application of the party claiming enforcement " .
15- عملا بالمادة السادسة من الاتفاقية، يجوز للسلطة التي يُحتجّ أمامها بقرار التحكيم أن تأمر الطرف المعارِض للتنفيذ بتقديم ضمان مناسب " بناءً على طلب الطرف الذي يطالب " بالتنفيذ.

(5) The arbitral tribunal may require the requesting party to provide appropriate security in connection with such interim measure.
(5) يجوز لهيئة التحكيم أن تُلزم الطرف الطالب بتقديم ضمان مناسب فيما يتعلق بذلك التدبير المؤقت.

" (4) The arbitral tribunal may require the requesting party and any other party to provide appropriate security as a condition to granting an interim measure of protection.

95. As a matter of drafting, it was stated that the use of the word " or " was more appropriate than the word " and " to indicate that the arbitral tribunal could require either the requesting party or any other party to provide appropriate security.
95- أما فيما يخص الصياغة، فقيل ان استعمال الأداة " أو " أنسب من استعمال الأداة " و " للإشارة إلى أنه يمكن لهيئة التحكيم أن تطلب من الطرف الطالب أو أي طرف آخر تقديم ضمان مناسب.

58. It was agreed that the term " security for costs " was too narrow and should, consistently with the approach taken in draft article 17, be replaced by a reference to " security " or " appropriate security " as provided in paragraph (4) of draft article 17.

It was recalled that the Working Group had, in earlier discussions, concluded that the provision of appropriate security should be a mandatory requirement to the granting of ex parte interim measures of protection (see A/CN.9/545, para. 69).

93. One proposal was to adopt wording along the following lines: " The arbitral tribunal may grant an interim measure of protection by having appropriate security furnished by the requesting party and any other party " , or simply by providing that, " appropriate security may be required to be provided by the requesting party and any other party before the arbitral tribunal grants an interim measure " .
93- قُدّم اقتراح باعتماد صيغة على غرار ما يلي: " يجوز لهيئة التحكيم أن توافق على اتخاذ تدبير حماية مؤقت بجعل الطرف الطالب وأي طرف آخر يقدّم ضمانا مناسبا " ، أو بمجرد نصها على أنه " يجوز أن يُشترط تقديم ضمان مناسب من جانب الطرف الطالب وأي طرف آخر قبل موافقة هيئة التحكيم على اتخاذ تدبير مؤقت " .

94. To address the concern that the provision of security should not be interpreted as a free-standing provision allowing the tribunal to order security at any time during the procedure, a proposal was made to redraft paragraph (4) as follows: " The arbitral tribunal may require the requesting party and any other party to provide appropriate security at the time the arbitral tribunal grants the interim measure " .
94- وبغية معالجة الشاغل بأنه لا ينبغي تفسير حكم تقديم الضمان على أنه حكم قائم بذاته يسمح لهيئة التحكيم بالأمر بتقديم الضمان في أي وقت أثناء الإجراءات، قُدم اقتراح بإعادة صياغة الفقرة (4) على النحو التالي: " يجوز لهيئة التحكيم أن تلزم الطرف الطالب وأي طرف آخر بتقديم ضمان مناسب حين تمنح هيئة التحكيم تدبير الحماية المؤقت " .

50. The fact that courts of Contracting States only consider whether to order security when contemplating adjournment does not mean that those courts should always order the party resisting enforcement to provide suitable security when an adjournment is granted.
50- أمَّا أنَّ المحاكم في الدول المتعاقدة لا تنظر فيما إذا كانت ستطلب تقديم الضمان سوى لدى التفكير في التأجيل فلا يعني أنَّ على تلك المحاكم أن تأمر الطرف المعارِض للتنفيذ على الدوام بتقديم ضمان مناسب عندما يُوافَق على التأجيل.
