The draft article applies to any State that has reasonable ground for believing that a planned activity in its territory could affect a transboundary aquifer and thereby cause a significant adverse effect on another State.

States shall, directly or through competent international organizations, provide scientific, educational, technical and other assistance to developing States for the protection and management of a transboundary aquifer or aquifer system.
تقدم الدول، مباشرة أو عن طريق المنظمات الدولية المختصة، مساعدة علمية وتعليمية وتقنية وغيرها من أشكال المساعدة إلى الدول النامية من أجل حماية وإدارة طبقة مياه جوفية أو شبكة طبقة مياه جوفية عابرة للحدود.
