وخلصت اللجنة الى أن في طرد مقدم البلاغ الى باكستان، في ظل الظروف الخاصة بحالة مقدم البلاغ، انتهاكا لالتزام كندا، بموجب المادة ٣ من الاتفاقية، بعدم طرد أو إعادة شخص الى دولة ثالثة حيث تتوافر أسباب حقيقية تدعو للاعتقاد بأنه سيكون في خطر التعرض للتعذيب.

11.2 The Committee must determine whether, by extraditing the alleged victim to Tunisia, the State party failed to fulfil its obligation under article 3, paragraph 1, of the Convention to refrain from expelling or returning a person to another State where there are substantial grounds for believing that he or she would be in danger of being subjected to torture.
11-2 ويجب على اللجنة أن تقرر ما إذا كانت الدولة بتسليمها صاحب الشكوى إلى تونس قد انتهكت التزامها بموجب الفقرة 1 من المادة 3 من الاتفاقية، بعدم طرد أو إعادة أي شخص إلى دولة أخرى إذا توافرت أسباب وجيهة تدعو إلى الاعتقاد بأنه سيواجه فيها خطر التعرض للتعذيب.

144. Accordingly, Tunisia undertakes not to extradite, expel or return any individual to any other State if justifiable reasons lead to the belief that the individual may face torture in that State.
144- وبالتالي وعملاً بما ذكر فإن البلاد التونسيّة متعهّدة بعدم تسليم أو طرد أو إعادة أي شخص إلى بلد، إذا توافرت لديها أسباب حقيقة تدعو إلى الاعتقاد بأنه سيكون في خطر التعرض للتعذيب.

7.2 The Committee must decide whether the deportation of the complainant to Colombia constituted a violation of the State party's obligation under article 3 of the Convention not to expel or return an individual to another State where there are substantial grounds for believing that he would be in danger of being subjected to torture.
7-2 ويجب على اللجنة أن تقرر ما إذا كان إبعاد صاحب الشكوى إلى كولومبيا قد شكل انتهاكاً من جانب الدولة الطرف لالتزاماتها بموجب المادة 3 من الاتفاقية، التي تنص على عدم طرد أو إعادة شخص إلى دولة أخرى إذا توافرت لديها أسباب حقيقية تدعو إلى الاعتقاد بأنه يواجه خطر التعرض للتعذيب.

6.2 The Committee must decide whether sending the author back to Nigeria would violate the State party’s obligation under article 3 of the Convention not to expel or return (refouler) an individual to another State if there are substantial grounds to believe that he would be in danger of being subjected to torture.
٦-٢ ويجب على اللجنة أن تقرر ما إذا كانت إعادة مقدم البلاغ إلى نيجيريا تشكل انتهاكا لالتزام الدولة الطرف بموجب المادة ٣ من الاتفاقية بعدم طرد أو إعادة فرد إلى دولة أخرى إذا كانت هناك أسباب جوهرية تدعو إلى الاعتقاد بأنه سيواجه خطر التعرض للتعذيب.

6.4 The Committee must decide whether the forced return of the author to Sri Lanka would violate the State party’s obligation under article 3, paragraph 1, of the Convention not to expel or return (refouler) an individual to another State where there are substantial grounds for believing that he/she would be in danger of being subjected to torture.
٦-٤ ولا بد من أن تقرر اللجنة ما إذا كانت إعادة مقدم البلاغ القسرية إلى سري لانكا ستشكل انتهاكا لالتزام الدولة الطرف، بموجب الفقرة ١ من المادة ٣ من الاتفاقية، بعدم طرد أو إعادة )إبعاد( فرد ما إلى دولة أخرى حين تتوافر أسباب حقيقية تحمل على الاعتقاد بأنه يواجه خطر التعرض للتعذيب.

4.1 In a letter of 19 August 1998, the State party informed the Committee that it had been unable to accede to the Committee’s invitation of 23 June 1998, pursuant to article 108, paragraph 9, of its rules of procedure, not to expel or return the author to Turkey since he and his family had been missing since 15 September 1996.
٤-١ في رسالة مؤرخة ١٩ آب/أغسطس ١٩٩٨، أفادت الدولة الطرف اللجنة بأنها لم تتمكن من الاستجابة لدعوة اللجنة لها في ٢٣ حزيران/يونيه ١٩٩٨، وفقا للفقرة ٩ من المادة ١٠٨، من نظامها الداخلي بعدم طرد أو إعادة مقدم البلاغ إلى تركيا حيث أن مقدم البلاغ وعائلته كانوا مفقودين منذ ١٥ أيلول/سبتمبر ١٩٩٦.

8.1 The Committee must decide whether sending the author back to Angola would violate Switzerland’s obligation under article 3 of the Convention not to expel or return (refouler) an individual to another State if there are substantial grounds for believing that he would be in danger of being subjected to torture.
٨-١ ويتعين على اللجنة أن تبت فيما إذا كانت إعادة مقدم البلاغ إلى أنغولا سيعتبر انتهاكا لالتزام سويسرا بموجب أحكام المادة ٣ من الاتفاقية بعدم طرد أو إعادة شخص إلى دولة أخرى حيث توجد أسباب حقيقية تدعو إلى الاعتقاد بأنه سيواجه خطر التعرض للتعذيب.

11.6 The Committee concludes that the expulsion or return of the author to Turkey in the prevailing circumstances would constitute a violation of article 3 of the Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment.
١١-٦ وخلصت اللجنة إلى أن طرد أو إعادة مقدم البلاغ إلى تركيا في ظل الظروف السائدة سيُشكل انتهاكا للمادة ٣ من اتفاقية مناهضة التعذيب وغيره من ضروب المعاملة أو العقوبة القاسية أو اللاإنسانية أو المهينة.
