Industrogradnja relied on the same deferred payment agreement to which Bojoplast referred (see paragraph 257, supra) to argue that the loss was direct. The Panel rejected this argument and stated that the losses represented debts and obligations of Iraq arising prior to 2 May 1990, and were, therefore, outside the Commission's jurisdiction (paragraph 156).
282- وتستند شركة Industrogradnja إلى نفس اتفاق الدفع المؤجل الذي أشارت إليه شركة بويوبلاست (انظر الفقرة 257 أعلاه) لتأكيد أن الخسارة كانت مباشرة ورفض الفريق هذه الحجة قائلاً إن الخسارة تمثل ديوناً والتزامات على العراق ناشئة قبل 2 أيار/مايو 1990، ومن ثم فهي خارجة عـن نطاق ولاية اللجنة (الفقرة 156).

The Panel finds that these receivables constitute debts or obligations of Iraq arising prior to 2 August 1990 over which the Panel has no jurisdiction and for the reasons stated in paragraph 88 above recommends no compensation for this claim.

In determining whether or not such claims are debts and obligations of Iraq arising prior to 2 August 1990 over which the Commission has no jurisdiction, the " E2A " Panel looked to the date of performance by the seller under the terms of the contract, i.e. the delivery of the goods, and the performance by the seller under the terms of the letter of credit, i.e. the presentation of the stipulated documents to the issuing bank.
