The violation of the human right to a defence in criminal cases amounts to non-observance of the international norms relating to the right to a fair trial, and is of such gravity as to give the deprivation of liberty an arbitrary character, in accordance with the terms of category III of the Working Group's methods of work.

5- (ج) إذا كان عدم التقيد كلياً أو جزئياً بالقواعد الدولية المتصلة بالحق في محاكمة عادلة، وهي القواعد المنصوص عليها في الإعلان العالمي لحقوق الإنسان وفي الصكوك الدولية ذات الصلة التي قبلتها الدول المعنية، من الخطورة بحيث يضفي على سلب الحرية طابعاً تعسفياً (الفئة الثالثة)؛

In its jurisprudence, to which the Working Group on Arbitrary Detention gives great weight in its own jurisprudence, the Inter-American Court has affirmed " that the authority which decides on the legality of an arrest or detention must be a judge or court; article 7, paragraph 6 of the Convention is therefore ensuring judicial control over the deprivation of liberty " .
54- وأكدت محكمة البلدان الأمريكية لحقوق الإنسان، في سوابقها القضائية التي يمنحها الفريق العامل المعني بالاحتجاز التعسفي وزناً كبيراً في اجتهاداته، أن " السلطة التي تفصل في شرعية توقيف أو احتجاز الأشخاص يجب أن تكون ممثلة في شخص قاض أو في محكمة؛ وبالتالي، تكفل الفقرة 6 من المادة 7 من الاتفاقية فرض الرقابة القضائية على سلب الحرية " ().
