In the event that the author's reference to article 14 is an error and the Committee wishes to consider his allegations under article 13, the State party submits that the allegations are inadmissible on grounds of incompatibility.

10.4 With respect to the issue of whether the death penalty violates article 7 of the Covenant, the State party submits that:

4.11 As to article 26, the State party emphasizes that the inability of homosexual couples to marry flows directly from article 23, paragraph 2, of the Covenant and cannot, therefore, constitute discrimination in terms of article 26.

If the Committee is of the view that article 14 does apply in this instance, the State party maintains that the citizenship revocation proceedings meet all the requirements of article 14, paragraph 1, since the author has been granted fair hearings before independent and impartial tribunals.

4.10 As to Mr. Tarawa, the State party submits that domestic remedies have not been exhausted.

However, in the event that the Committee wishes to consider the human rights situation in India, the State party submits that the situation does not provide corroboration of the author's allegations.

Therefore, the State party submits that discrimination against the authors ended in 1985 for Ms. Campo-Trumel, in 1977 for Ms. Muzard-Fekkar and in 1993 for Ms. Remy-Cremieu.

4.3 As to the claim that Mr. Rastorguev was detained for six days without being informed of charges against him, the State party submits that the investigation in the murder case was initiated several months before his detention.
4-3 وأما فيما يخص الادعاء بأن السيد راستورغيف احتُجز لمدة ستة أيام دون أن يُخبر بالتهم الموجهة إليه، فإن الدولة الطرف تؤكد أن التحقيق في قضية القتل بدأ قبل احتجازه بعدة أشهر.

4.8 In the alternative, should the Committee consider that the length of residency, or being a immigrant from a country with which Canada does not have a reciprocal international social security agreement falls within the scope of the notion of " other status " , the State party submits that the differential treatment clearly does not amount to discrimination within the meaning of article 26.

4.4 As regards the author's remaining complaints about the partiality of the investigations against him, the State party emphasizes that the criminal procedures against the author are still pending and that his guilt has not yet been determined by a tribunal.
٤-٤ وفيما يتعلق بالادعاءات المتبقية لصاحب البلاغ المتعلقة بعدم نزاهة التحقيقات التي أجريت معه، فإن الدولة الطرف تؤكد أن اﻹجراءات الجنائية لا تزال جارية مع صاحب البلاغ وأنه لم تتقرر إدانته بعد عن طريق المحكمة.

4.4 As regards the author's remaining complaints about the partiality of the investigations against him, the State party emphasizes that the criminal procedures against the author are still pending and that his guilt has not yet been determined by a tribunal.
٤-٤ وفيما يتعلق بالادعاءات المتبقية لمقدم البلاغ المتعلقة بعدم نزاهة التحقيقات التي أجريت معه، فإن الدولة الطرف تؤكد أن اﻹجراءات الجنائية لا تزال جارية مع مقدم البلاغ وأنه لم تتقرر إدانته بعد عن طريق المحكمة.

4.9 Even if the claim is arguable in respect of article 20, the State party emphasizes that the authors did have access to an effective remedy as required by article 2, and the claim is therefore manifestly ill-founded and discloses no violation on the merits.

5.11 the State party maintains that even if the Committee concludes that it is able to consider the situation subsequent to the author’s expulsion to the United States, the communication should still be considered inadmissible because the author has not established a minimum of support for his communication.
٥-١١ وحتى لو قررت اللجنة أن باستطاعتها دراسة الحالة التي أعقبت طرد مقدم البلاغ إلى الولايات المتحدة، فإن الدولة الطرف تؤكد أن هذا البلاغ ينبغي مع ذلك الحكم بعدم مقبوليته نظرا إلى أن مقدم البلاغ لم يقم الحد اﻷدنى من الدلائل التي تدعم بلاغه.

4.4 With reference to article 22 of the Constitution, the State party maintains that all citizens are equal before the law and entitled to protection by the State.
4-4 أما فيما يتعلق بالمادة 22 من الدستور، فإن الدولة الطرف تؤكد أن جميع المواطنين متساوون أمام القانون، ويحق لهم التمتع بحماية الدولة.

With respect to the allegation made by the authors that there are no domestic remedies available to them in violation of the Covenant the State party contends that the reason the authors can find no remedies available for their claims is because these do not fall within the scope of the Covenant, rather than because New Zealand does not provide remedies for possible violations of the Covenant.
أما بالنسبة إلى ادعاء أصحاب البلاغ عدم وجود سبل انتصاف محلية متاحة لهم، الأمر الذي اعتبروه انتهاكاً للعهد، فإن الدولة الطرف تؤكد أن السبب في أن أصحاب البلاغ لا يجدون أي سبل انتصاف متاحة فيما يخص شكاواهم يرجع إلى أن هذه الشكاوى لا تقع ضمن نطاق العهد وليس لأن نيوزيلندا لا توفر سبل انتصاف فيما يخص الانتهاكات الممكنة للعهد.

Consequently, the State party contends that the author's communication is incompatible with the provisions of the Convention and should thus be declared inadmissible by virtue of article 4, paragraph (2) (b), of the Optional Protocol.
