٨٢١- وفيما يتعلق بواجب اتخاذ خطوات لحماية المعدات، مثل دهنها بطلاء واق أو تغطية المعدات بالتربولين، فإن الفريق يلاحظ أن الخسائر التي تلتمس الشركات المطالبة التعويض عنها خسائر كلية لﻷصول المادية الموجودة في العراق في تاريخ مغادرة العراق من جانب القوى العاملة التابعة للشركات المطالبة.

Such losses could not have been avoided by covering or painting the equipment.As for the alleged duty to have removed the assets from Iraq at the time of departure, the Panel notes that in the Claims before it, the assets in question consisted of vast amounts of heavy construction equipment.

42. Although the secretariat has used reasonable and practical means to detect the existence of duplicate claims within the " A " claims category, the Panel notes that the secretariat's ability to perform this task successfully depends to a large extent on the existence and quality of the information contained in the claim form.
٢٤ - ورغم أن اﻷمانة قد استخدمت وسائل معقولة وعملية للكشف عن وجود مطالبات مزدوجة في اطار فئة المطالبات من الفئة " ألف " ، فإن الفريق يلاحظ أن قدرة اﻷمانة على أداء هذه المهمة بنجاح تعتمد إلى حد كبير على وجود ونوعية المعلومات الواردة في استمارة المطالبة.

In respect of the claim by Al Towaijri for unbilled contract expenses, the Panel notes that the claimant provided evidence that it was party to a contract with the Kuwaiti National Housing Authority (the " NHA " ) for the construction of houses at the Al-Qurain Housing Project.
33- أما بالنسبة للمطالبة التي تقدمت بها شركة التويجري لتعويض نفقات العقود التي لم يصدر بشأنها فواتير فإن الفريق يلاحظ أن صاحب المطالبة أثبت بأنه كان طرفاً في عقد مع هيئة الإسكان الوطنية في الكويت لتشييد المنازل في مشروع إسكان القرين.

With respect to the claim for the amount of the difference between the original purchase price of the securities and their sale price, the Panel notes that the claimant was requested, pursuant to an article 34 notification, to submit evidence demonstrating that it had an obligation to pay Pasfin for the difference between the original purchase price of the securities and the sale price of the securities.
181- أما فيما يتعلق بمطالبة تعويض الفرق بين سعر الشراء الأصلي للسندات وسعر بيعها، فإن الفريق يلاحظ أن طلبا وجه إلى الجهة المطالبة، وفقا لإخطار موَجَّه بموجب المادة 34 من القواعد، لتبرهن على أنها ملزمة بأن تدفع للسمسار الفرق بين سعر الشراء الأصلي للسندات وسعر بيعها.

With respect to the sixth building that required reconstruction, the Al Khafji Headquarters building, the Panel notes that an examination of the Claimant's expert's report states that " this building had been evacuated almost ten years prior to Iraq's attack and it had long been scheduled for demolition " .
527- أما بالنسبة إلى المبنى السادس الذي تطلب إعادة البناء، أي مبنى المقر في الخفجي، فإن الفريق يلاحظ أن فحصاً لتقرير الخبراء الذي قدمته الجهة المطالبة يبين أن " هذا المبنى كان قد أخلي قبل 10 سنوات تقريباً من هجوم العراق وأن هدمه كان مقرراً منذ أمد طويل " .

With regard to the airport services provided prior to the date of Iraq's invasion of Kuwait, the Panel notes that paragraph 16 of Security Council resolution 687 (1991) states:

In contrast, where a shipping claimant provides charter (non-scheduled) services, the Panel notes that each charter will be negotiated individually at the prevailing market rate and that there is no commitment on the part of the shipowner nor on the charterer to renew such charters in the future.
