With regard to Iraq's comments on the cost-effectiveness of remediation techniques, the Panel notes that one of the purposes of the programme is to evaluate the effectiveness and costs of different techniques.

As to quantum, the Panel notes that there may be instances in which tangible assets are wholly written off in a claimant's books of account as at 2 August 1990.
167- أما فيما يتعلق بالمقادير، فيلاحظ الفريق أنه توجد حالات تكون فيها الأصول المادية مشطوبة بالكامل في دفاتر حسابات صاحب المطالبة في 2 آب/أغسطس 1990.

Iraq notes that Iran bases its estimate of the increase in the number of cases of PTSD and panic disorder requiring treatment on a study sample of 2,764 people and then applies the results to the entire population of Khuzestan and Bushehr over 12 years of age in 2003.
فيلاحظ العراق أن إيران تعتمد في تقديرها على زيادة عدد تلك الاضطرابات واضطرابات الهلع التي استلزمت علاجاً استناداً إلى عينة لإجراء الدراسة تتألف من 764 2 شخصاً، ثم تطبِّق نتائجها على كافة سكان خوزستان وبوشهر الذين تجاوز عمرهم 12 سنة عام 2003.

As to the analogy made by the State party with wearers of thick glasses, counsel notes that a Sikh turban does not obscure the eyes, and is worn to cover the hair; in addition glasses are not intertwined with the wearer's religious identity, and their removal in public neither humiliates the wearer nor is tantamount to repudiating the wearer's faith.
وأما عن تشبيه الدولة الطرف حامل العمامة بحامل نظارات سميكة، فيلاحظ المحامي أن عمامة السيخي لا تحجب العينين، وإنما توضع لتغطية الشعر؛ ثم إن النظارات ليست مرتبطة بالهوية الدينية لحاملها، وأن رفعها أمام الناس لا يشكل إهانة لحاملها ولا بمثابة تنصل حاملها من عقيدته.

As to the State party's note that the views contradicted established and legally binding case law of international tribunals, i.e., the European Court of Human Rights, counsel notes that the said case law acknowledged that there is an interference with the person's private life when his/her name is subjected to modifications.
أما فيما يتعلق بملاحظة الدولة الطرف أن الآراء تتناقض مع سوابق قانونية راسخة وملزمة قانونا لمحاكم دولية، أي المحكمة الأوروبية لحقوق الإنسان، فيلاحظ المحامي أن السوابق القانونية المذكورة تقر بوجود تدخل في الحياة الخاصة للشخص عندما يفرض عليه تعديل اسمه.

As to claims processing costs, the Panel notes that decision 18 / provides for compensation for such costs by allowing for the deduction of a set fee from payments made to claimants.
94- أما فيما يتعلق بتكاليف تجهيز المطالبات، فيلاحظ الفريق أن المقرر18(31) ينص على تعويض هذه التكاليف فيجيز اقتطاع رسم معين من المدفوعات المسددة للمطالبين.

5.2 As to the cause of Mr. Burrell's death, counsel notes that the pathologist's report, of which the State party has provided no copy, states that he died of shotgun and blunt force injuries, but that the State party has given no details as to how Mr. Burrell was killed.
٥-٢ أما فيما يخص سبب وفاة السيد باريل فيلاحظ المحامي أن تقرير الطبيب الشرعي الذي لم تقدم منه الدولة الطرف أي نسخة، يؤكد أنه مات من جراء إصابات رصاص وقوة راضة لكن الدولة الطرف لم تقدم أية تفاصيل تبين كيف مات السيد باريل.

As to the second claim described in paragraph , the Panel notes that, given the reasonable estimate of the duration of passage between Los Angeles and Kuwait, the goods would not have arrived in Kuwait by 2 August 1990 and therefore could not have been lost as a direct result of Iraq's invasion and occupation of Kuwait.
99- أما المطالبة الثانية المذكورة في الفقرة 90 أعلاه، فيلاحظ الفريق أنه نظراً للتقدير المعقول لمدة المرور بين لوس أنجلوس والكويت، لم يكن من الممكن وصول السلع إلى الكويت بحلول 2 آب/أغسطس 1990، وبالتالي لم يكن من الممكن فقدها كنتيجة مباشرة لغزو العراق واحتلاله للكويت.

In the case of dependants, however, the Panel notes that the claimant seeks compensation for payments in respect of pain and suffering and for specific post-traumatic syndrome, although it also provided evidence that its own rules limit compensation for personal injuries to the cost of medical treatment.
89- أما في حالة المعالين، فيلاحظ الفريق أن المطالـب يلتمس التعويض عن المدفوعات التي قدمها مقابل الآلام والمعاناة والأعراض النوعية لما بعد الصدمة على الرغم من أنه قد قدم دليلاً أيضاً على أن القواعد الخاصة به تقصر التعويضات بالنسبة للاصابات الشخصية على تكاليف العلاج الطبي.

With respect to the claim for overtime of civilian staff, the Panel notes that the evidence includes a report dated July 1996 setting out the overtime amounts allegedly paid to staff in each of the five regions of Saudi Arabia.
514- أما بالنسبة إلى المطالبة بتعويض عن تكاليف العمل الإضافي للموظفين المدنيين، فيلاحظ الفريق أن الأدلة تشمل تقريراً مؤرخاً تموز/يوليه 1996 يحدد المبالغ المزعوم دفعها للموظفين مقابل عمل إضافي في كل منطقة من المناطق الخمس في المملكة العربية السعودية.

With respect to the claim for marine equipment and spare parts, the Panel notes that the claim includes an amount of SAR 8,226,172 for the purchase of three hovercraft, which were ordered during the period of Iraq's invasion and occupation of Kuwait but were not delivered until after this period.
556- أما بالنسبة إلى المطالبة المتعلقة بالمعدات البحرية وقطع الغيار، فيلاحظ الفريق أن المطالبة تشمل مبلغ 172 226 8 ريالاً سعودياً لشراء ثلاث حوامات طلبت خلال فترة غزو العراق واحتلاله للكويت، ولكنها لم تسلم إلا بعد هذه الفترة.
