The State party should establish its jurisdiction over acts of torture in cases where the alleged offender is present in any territory under its jurisdiction, either to extradite or prosecute him or her, in accordance with the provisions of the Convention.
ينبغي للدولة الطرف فرض ولايتها القضائية على أفعال التعذيب في الحالات التي يكون فيها المدعى ارتكابه للجرم موجوداً في أي من الأقاليم الخاضعة لولايتها، وذلك لتسليمه أو مقاضاته، وفقاً لأحكام الاتفاقية.

The Committee recommends that the State party take steps to allow the National Commission on Security Ethics to accept complaints directly from anyone claiming to have been subjected to torture or cruel, inhuman or degrading treatment in any territory under its jurisdiction, in accordance with article 13 of the Convention.
توصي اللجنة الدولة الطرف باتخاذ التدابير اللازمة التي تسمح لأي شخص يَدّعي أنه تعرض للتعذيب أو المعاملة القاسية أو اللاإنسانية أو المهينة في أي من الأقاليم الخاضعة لولايتها القضائية بأن يرفع شكواه مباشرة إلى اللجنة الوطنية لأخلاقيات الأمن، وفقاً لأحكام المادة 13 من الاتفاقية.

The Committee recommends that the State party should take the necessary measures to allow the CNDS to accept cases referred to it directly by any person who claims to have been subjected to torture or cruel, inhuman or degrading treatment in any territory under its jurisdiction, in accordance with article 13 of the Convention.

Article 12 of the Convention against Torture expressly obligates States parties to investigate all allegations of torture, asserting that each State party should ensure that its competent authorities proceed to a prompt and impartial investigation wherever there is reasonable ground to believe that an act of torture has been committed in any territory under its jurisdiction.
49- وتلزم المادة 12 من اتفاقية مناهضة التعذيب صراحة الدول الأطراف بالتحقيق في جميع ادعاءات التعذيب، وتؤكد أن على كل دولة طرف أن تضمن قيام سلطاتها المختصة بتحقيق فوري ونزيه كلما وجدت أسباب معقولة تدعو إلى الاعتقاد بأن عملاً من أعمال التعذيب قد ارتكب في أي من الأقاليم الخاضعة لولايتها القضائية.

75. The Special Rapporteur welcomes the recent entry into force of the Optional Protocol to the Convention against Torture and reminds States parties to the Convention of their obligation under its article 2 to take effective measures to prevent acts of torture in any territory under their jurisdiction.
75 - ويرحب المقرر الخاص بدخول البروتوكول الاختياري لاتفاقية مناهضة التعذيب حيز النفاذ. وهو يذكّر الدول الأطراف في الاتفاقية بالتزاماتها بموجب المادة 2 بأن تتخذ إجراءات فعالة لمنع أعمال التعذيب في أي من الأقاليم التابعة لولايتها.

According to article 12, States parties shall undertake prompt, effective and impartial investigations, wherever there is reasonable ground to believe that an act of torture has been committed in any territory under its jurisdiction as the result of its actions or omissions and, as set out in article 13 and affirmed by the Committee in its general comment No. 2, ensure that impartial and effective complaints mechanisms are established.
وبموجب المادة 12، على الدول الأطراف إجراء تحقيقات سريعة وفعالة ونزيهة كلما وُجدت أسباب معقولة تدعو إلى الاعتقاد بأن عملاً من أعمال التعذيب قد ارتُكب في أي من الأقاليم الخاضعة لولايتها القضائية نتيجة أفعالها أو امتناعها عن أفعال وعليها، مثلما تبين المادة 13 ومثلما أكدت اللجنة في تعليقها العام رقم 2، أن تضمن إقامة آليات نزيهة وفعالة لتقديم الشكاوى.

The Working Group further recalls that, pursuant to the Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment, to which Bahrain is also a party, the Government " shall ensure that its competent authorities proceed to a prompt and impartial investigation, wherever there is reasonable ground to believe that an act of torture has been committed in any territory under its jurisdiction " (article 12).
29- ويذكّر الفريق العامل كذلك بأن اتفاقية مناهضة التعذيب وغيره من ضروب المعاملة القاسية أو اللاإنسانية أو المهينة، التي انضمت إليها البحرين أيضاً، تنص على أن تكفل الحكومة " قيام سلطاتها المختصة بإجراء تحقيق سريع ونزيه كلما وجدت أسباب معقولة تدعو إلى الاعتقاد بأن عملاً من أعمال التعذيب قد ارتكب في أي من الأقاليم الخاضعة لولايتها القضائية " (المادة 12).

Article 12 of the Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment also expressly obliges States parties to investigate all allegations of torture, in stipulating that they ensure that their competent authorities proceed to a prompt and impartial investigation, wherever there is reasonable ground to believe that an act of torture has been committed in any territory under its jurisdiction.
كما أن المادة 12 من اتفاقية مناهضة التعذيب وغيره من ضروب المعاملة أو العقوبة القاسية أو اللاإنسانية أو المهينة تلزم صراحة الدول الأطراف بالتحقيق في جميع ادعاءات التعذيب، فهي تنص على أن " تضمن هذه الدول الأطراف قيام سلطاتها المختصة بإجراء تحقيق سريع ونزيه كلما وُجدت أسباب معقولة تدعو إلى الاعتقاد بأن فعلاً من أفعال التعذيب قد ارتكب في أي من الأقاليم الخاضعة لولايتها().
