Draft article 26 extends a range of procedural rights to aliens who are unlawfully in the territory of a State party for more than six months.

Article 13 of the International Covenant on Civil and Political Rights stipulates that a person lawfully in the territory of a State party may not be expelled without having access to due process of law.
فالمادة 13 من العهد الدولي الخاص بالحقوق المدنية والسياسية تنص على أنه لا يجوز إبعاد الأجنبي المقيم بصفة قانونية في إقليم دولة طرف إلا تنفيذاً لقرار اتُخذ وفقاً للقانون.

1. A person who is being detained or is serving a sentence in the territory of one State Party whose presence in another State Party is requested for purposes of identification, testimony or otherwise providing assistance in obtaining evidence for the investigation or prosecution of offences set forth in article 2 may be transferred if the following conditions are met:
١ - يجوز نقل أي شخص محتجز أو يقضي عقوبته في إقليم دولة طرف ومطلوب وجوده في دولة أخرى من الدول اﻷطراف ﻷغراض تحديد الهوية أو الشهادة أو المساعدة من نواح أخرى في الحصول على أدلة ﻷغراض التحقيق في الجرائم المبينة في المادة ٢ أو المحاكمة عليها، إذا استوفى الشرطان التاليان:

1. A person who is being detained or is serving a sentence in the territory of one State Party whose presence in another State Party is requested for purposes of identification, testimony or otherwise providing assistance in obtaining evidence for the investigation or prosecution of offences under this Convention may be transferred if the following conditions are met:
١ - يجوز نقل أي شخص محتجز أو يقضي عقوبته في إقليم دولة طرف ومطلوب وجوده في دولة أخرى من الدول اﻷطراف ﻷغراض تحديد الهوية أو الشهادة أو المساعدة في إثبات الوقائع في إطار عمليات التحقيق أو المحاكمة بموجب هذه الاتفاقية، إذا استوفي الشرطان التاليان:

First, it is possible if the crime occurred on the territory of a State Party (Rome Statute, article 12 (2) (a)).
فهو ممكن، أولا، إذا كانت الجريمة قد وقعت في إقليم دولة طرف (نظام روما الأساسي، المادة 12 (2) (أ)).
