The Committee observes that the author has failed to raise any of the claims made in the present communication before any court in the State party.

The State party submits that the complaints before the European Court and the present communication are of a similar nature as they have been submitted by the same person, concern the rights of the same group of persons (belonging to sexual minorities) and concern the actions of the same authorities.

6.4 With regard to the claim of an alleged violation of articles 2, paragraph 3, and 14, paragraph 1, of the Covenant, the Committee observes that the author makes no allegation of arbitrariness, manifest injustice or other permissible basis on which to revisit the related judicial decisions and proceedings, but only refers to the rights of her ex-husband, who is not a party to the present communication.

11.1 The Human Rights Committee has considered the present communication in the light of all the information made available to it by the parties, as provided in article 5, paragraph 1, of the Optional Protocol.

In the circumstances, the Committee considers that the question of exhaustion of domestic remedies in the present communication is so closely linked to the merits of the case that it is inappropriate to determine it at the present stage of the proceedings and that it should be joined to the merits.

As in the present communication, the deceased requested the Court to find that she had been a victim of discrimination because the group of persons to which she belongs was dispossessed of their property without compensation and for no objective reasons, unlike other groups of owners.

6.5 With regard to the State party's objection that the communication was inadmissible for non-exhaustion of domestic remedies, the Committee noted that all the issues raised in the present communication have been brought before the domestic courts of the State party in the several applications filed by the author, and have been considered by the State party's highest judicial authority.
