1. If the requested State Party so agrees, the competent authorities of the requesting State Party may nominate suitably qualified persons to witness the execution of the request for mutual assistance.
1 - إذا وافقت الدولة الموجه إليها الطلب، يجوز للسلطات المختصة في الدولة الطرف الطالبة أن تعيّن أشخاصا مؤهلين لحضور تنفيذ طلب المساعدة.

(h) Facilitating the appearance of persons in the requesting State Party;

Mutual legal assistance shall be afforded to the fullest extent possible under relevant agreements and arrangements of the requested State Party with respect to investigations, prosecutions and judicial proceedings in relation to the offences for which a legal person may be held liable in accordance with article 18 of this Convention in the requesting State Party.
2- تقدم المساعدة القانونية المتبادلة على أتم وجه ممكن، في اطار اتفاقات الدولة الطرف متلقية الطلب وترتيباتها ذات الصلة، فيما يتعلق بالتحقيقات والملاحقات والإجراءات القضائية الخاصة بالجرائم التي يجوز تحميل هيئة اعتبارية المسؤولية عنها بمقتضى المادة 18 من هذه الاتفاقية في الدولة الطرف الطالبة.

(b) The law of the requesting State Party permits or requires that person to decline to give evidence in similar circumstances in proceedings originating in the requesting State Party.
(ب) أو كان قانون الدولة الطرف الطالبة يمنح الحق لهذا الشخص أو يلزمه بالامتناع عن الإدلاء بشهادته في ظروف مماثلة في إطار إجراءات جارية في الدولة الطرف الطالبة.

1. The States Parties undertake to extradite to the other, upon request and subject to the provisions of the present Convention, any person who is wanted in the requesting State Party for prosecution for any offence provided for in the international counter-terrorism instruments, or for the imposition or enforcement of a sentence in respect of such an offence.
1 - تلتزم الدول الأطراف بأن تسلِّم لبعضها بعض، بناء على طلبها ووفقا لأحكام هذه الاتفاقية، الأشخاص المطلوبين لأغراض المحاكمة في الدولة الطرف الطالبة بسبب ارتكاب أي جريمة تنص عليها الصكوك العالمية بشأن مكافحة الإرهاب، أو لأغراض إنزال أو إنفاذ مدة عقوبة تتصل بهذه الجريمة.

:: Consider the possibility of establishing a domestic procedure to facilitate the voluntary appearance of persons in the requesting State Party and the transfer and receiving of persons who are being detained or serving a sentence (art. 46, paras. 3 (h) and 10 to 12).

(d) The person transferred shall receive credit for service of the sentence imposed in the State from which he or she was transferred for time served in the custody of the State to which he or she was transferred. The delegation of Mexico proposed the insertion of the following subparagraph: “The authorities of the requested State Party may be present at proceedings conducted in the requesting State Party.”
)د( يتعين احتساب مدة العقوبة التي يقضيها الشخص المنقول محتجزا في الدولة التي نقل إليها كجزء من المدة المحكوم بها عليه في الدولة التي نقل منها .اقترح وفد المكسيك اضافة الفقرة الفرعية التالية : " يجوز لسلطات الدولة الطرف متلقية الطلب أن تحضر أثناء الاجراءات التي تنظم في الدولة الطرف الطالبة . "

" (ii) A final judgement establishing title to or ownership of the assets issued by a competent court of the requesting State Party, which judgement may be given effect in the territory of the requested State Party;

" (b) Permit its competent authorities to give effect to a final judgement of a competent court of the requesting State Party ordering the confiscation of illicitly acquired assets located in the territory of the requested State Party;

In the practice of extradition, some solutions had been found to conflicts between the obligation to extradite and other governing principles such as due process or protection against torture, which might be lacking in a requesting State.
وأضاف أنه في ممارسة التسليم، وجدت بعض الحلول للنزاعات بين الالتزام بالتسليم والمبادئ التنظيمية الأخرى كالإجراءات القانونية الواجبة أو الحماية من التعذيب التي قد لا تكون متوفرةً في الدولة الطرف الطالبة.

Azerbaijan indicated that it would not be able to facilitate the voluntary appearance of persons in a requesting State party (para. 3 (h)).
وأشارت أذربيجان إلى أنها لن تكون قادرة على تيسير مثول الأشخاص طواعية في الدولة الطرف الطالبة (الفقرة 3 (ح)).
