While the Convention's key principles have been successfully applied to the control of trade in ozone-depleting substances by some ozone regional networks, the Convention by its terms does not cover ozone-depleting substances or wastes.

Paragraph 7 of decision XIV/7 on monitoring of trade in ozone-depleting substances provides in relevant part that quantities of illegally traded ozone-depleting substances should not be counted against a Party's consumption provided the Party does not place such quantities on its own market.

To note with appreciation the notes by the Secretariat on information reported by the Parties on illegal trade in ozone-depleting substances and on streamlining the exchange of information on reducing illegal trade in ozone-depleting substances;

Between 2001 and 2011, out of 11 evaluations, UNIDO was ranked as the top implementing agency nine times, and as the second two times. 2012 marks the 25th anniversary of the Montreal Protocol, and UNIDO will organize a week-long event at its headquarters in Vienna in September to celebrate the success in achieving reductions in ozone-depleting substances that will protect the atmosphere for generations to come.

In decision XVI/33, the Secretariat was requested, among other things, to produce draft terms of reference for a study on the feasibility of developing a tracking system for the trade in ozone-depleting substances and the costs of such a system, and, funds permitting, to convene a workshop of experts from Parties to develop specific areas and a conceptual framework of cooperation to combat illegal trade.

As a consequence, the Parties to the Protocol took decision XVI/33, which, among other things, directed the Secretariat " to produce draft terms of reference for a study on the feasibility of developing a system of tracking trade in ODS and the cost implications of carrying out such a study, taking into account the proposal presented by Sri Lanka. "
