There are many criminal justice practices used by States to combat irregular migration, including greater criminalization of migration offences (as opposed to treating them as an administrative offence) and cross-border collaboration by police and other authorities, which have, in certain cases, resulted in increased violations against migrants.
وهناك العديد من ممارسات القضاء الجنائي التي تستخدمها الدول لمكافحة الهجرة غير الشرعية منها زيادة تجريم الجنح المتعلقة بالهجرة (مقابل اعتبارها جنحاً إدارية) والتعاون عبر الحدود بين قوات الشرطة وغير ذلك من السلطات، ممّا أدى، في بعض الحالات، إلى ارتفاع الانتهاكات المرتكبة في حق المهاجرين.

40. All these violations concerning migrants who travel by sea contribute to the phenomenon of the increasing criminalization of irregular migration, putting both the migrants and the rescuers at risk of potential abuses.
