٦٣٢- وتلاحظ اللجنة مع القلق أن مبدأي خير ما هو في صالح الطفل واحترام آراء الطفل وحقه في الاشتراك في الحياة اﻷسرية والمدرسية والاجتماعية لا تنعكس انعكاساً كاملاً في التشريعات الداخلية ولا تُنفذ تنفيذاً تاماً من الناحية العملية.

The subject of the conference was “The best interests of the child in the European Union and the political and legal status of the Convention on the Rights of the Child in the European Union”.
وكان موضوع المؤتمر هو " خير ما هو في صالح الطفل في الاتحاد اﻷوروبي والمركز السياسي والقانوني لاتفاقية حقوق الطفل في الاتحاد اﻷوروبي " .

880. The Committee notes with concern that the principles of the best interests of the child, respect for the views of the child, and his or her right to participate in family, school and social life are not fully reflected in domestic legislation or implemented in practice.
٠٨٨ - وتلاحظ اللجنة مع القلق أن مبدأي خير ما هو في صالح الطفل واحترام آراء الطفل وحقه في الاشتراك فــي الحيــاة اﻷسرية والمدرسية والاجتماعية لا تنعكس انعكاسا كاملا في التشريعات الداخلية ولا تُنفذ تنفيذا تاما من الناحية العملية.

In the various measures to be adopted, the family should be involved, to the extent that it operates in favour of the good of the child offender.
وينبغي اشراك اﻷسرة في مختلف التدابير المتخذة بقدر ما يكون ذلك في صالح الطفل الجاني.

46. The Committee is of the view that insufficient measures have been taken to ensure the implementation of the general principles of the Convention in policy, practice and procedures, especially with regard to article 3 (the best interests of the child) and article 12 (respect for the views of the child).
٦٤- وترى اللجنة أن عدم التدابير المتخذة غير كافية لكفالة تنفيذ المبادئ العامة للاتفاقية في السياسة العامة، والممارسة والاجراءات، وخاصة فيما يتعلق بالمادة ٣ )خير ما هو في صالح الطفل( والمادة ٢١ )احترام آراء الطفل(.

185. The Committee wishes to express its concern that the principles and provisions of the Convention, especially its general principles, as reflected in its articles 2 (non-discrimination), 3 (best interests of the child), 6 (right to life, survival and development) and 12 (respect for the views of the child), have not yet been fully taken into account in legislative and other measures relevant to children.
٥٨١- ومما يثير قلق اللجنة أن مبادئ وأحكام الاتفاقية، وخاصة مبادئها العامة كما هي مبينة في المواد: ٢ )عدم التمييز( و٣ )خير ما هو في صالح الطفل( و٦ )الحق في الحياة والبقاء والنماء( و٢١ )احترام آراء الطفل(، لم تؤخذ في الاعتبار على نحو كامل في التدابير التشريعية وغيرها من التدابير ذات الصلة باﻷطفال.

690. The Committee is of the view that insufficient measures have been taken to ensure the implementation of the general principles of the Convention in policy, practice and procedures, especially with regard to article 3 (the best interests of the child) and article 12 (respect for the views of the child).
٠٩٦ - وترى اللجنة أن عدم التدابير المتخذة غير كافية لكفالة تنفيذ المبادئ العامة للاتفاقية في السياسة العامة، والممارسة والاجراءات، وخاصة فيما يتعلق بالمادة ٣ )خير ما هو في صالح الطفل( والمادة ٢١ )احترام آراء الطفل(.

With respect to article 4 of the Convention, the Committee, while noting efforts made in allocating resources to the social sector, is of the view that greater budgetary provisions need to be made to overcome and remedy existing disparities and develop, with the assistance of international cooperation, a comprehensive strategy for children, taking due account of the best interests of the child.
٧٥١- وفيما يتعلق بالمادة ٤ من الاتفاقية، فإن اللجنة إذ تنوه بالجهود التي بذلت في تخصيص موارد للقطاع الاجتماعي، ترى أن من الضروري اتخاذ الترتيبات لتخصيص اعتمادات أكبر في الميزانية بغية التغلب على التفاوتات الحالية وعلاجها والقيام، بمساعدة التعاون الدولي، بوضع استراتيجية شاملة لﻷطفال تأخذ بعين الاعتبار خير ما هو في صالح الطفل.

801. The Committee is concerned about the unclear status of the Convention in the domestic legal framework and the insufficient steps taken to bring existing legislation into full conformity with the Convention, including in light of the general principles of non-discrimination (art. 2), the best interests of the child (art. 3), the right to life, survival and development (art. 6) and respect for the views of the child (art. 12).
٥٣١- ويساور اللجنة القلق ازاء المركز غير الواضح للاتفاقية في اﻹطار القانوني المحلي وعدم كفاية الخطوات المتخذة لجعل التشريع الحالي متوافقا تماما مع الاتفاقية، وذلك، في جملة أمور، في ضوء المبادئ العامة لعدم التمييز )المادة ٢(، وخير ما هو في صالح الطفل )المادة ٣( والحق في الحياة والبقاء والنمو )المادة ٦(، واحترام آراء الطفل )المادة ٢١(.

The Committee is concerned about the unclear status of the Convention in the domestic legal framework and the insufficient steps taken to bring existing legislation into full conformity with the Convention, including in the light of the general principles of non-discrimination (art. 2), the best interests of the child (art. 3), the right to life, survival and development (art. 6) and respect for the views of the child (art. 12).

The provision however, cannot be considered as an endorsement of corporal punishment, since the provision has to be construed jointly with the definition of parental authority specified in the Code as actions exclusively for the good of the child.
إلا أنه لا يمكن تفسير هذا الحكم على أنه يبيح العقوبة الجسدية، إذ يجب تفسيره بالاقتران مع تعريف السلطة الأبوية التي يقصرها القانون على تلك الأفعال التي تكون في صالح الطفل.
