The Organic Education Act of 1993 sets out that the assistance for pupils with special education needs shall be guided by the principle of integration, and that they are entitled to receive school and occupational guidance, as well as to receive the support necessary to compensate for possible deficiencies of the family, economic, social and cultural kind.

In January 2000, a provision on " promoting equal education for men and women " was newly added to the Basic Education Act to state clearly that the national and local governments should formulate and implement policies to more actively realize the principle of gender equality in education.

In Kenya, under Article 64 (1) of the Basic Education Act of 2013 the Education Standards and Quality Assurance Council was established to ensure standards and to maintain quality by monitoring the conduct of assessments and examinations in institutions of basic education.

Article 31 of the Constitution and Article 3 (Right to Learn) and Article 4 (Equal Opportunity for Education) of the Basic Education Act provide that every citizen has the right to learn throughout life and receive equal education according to one's capacity and aptitude without gender-based discrimination.

216. Under the Basic Education Act No. 32 of 7 April 2002 (see annex 7), primary and middle school education were merged into a single stage, namely, the basic education stage. Basic education is free and compulsory from the first to the ninth grades.

44. The Committee recommends that the State party give serious consideration to reintegrating the promotion of gender equality in the Basic Act on Education so that the State party's commitment under the Convention to protect women's full rights in the field of education is integrated into domestic law.
44 - توصي اللجنة بأن تنظر الدولة الطرف جدياً في إعادة إدماج تعزيز المساواة بين الجنسين في قانون التعليم الأساسي حتى يتسنى جعل التزام الدولة الطرف بموجب الاتفاقية بحماية الحقوق الكاملة للمرأة في ميدان التعليم جزءا من القانون المحلي.
