Detention of migrants belonging to vulnerable categories and in need of special assistance should be only allowed as a measure of last resort, and they should be provided with adequate medical and psychological assistance;
وينبغي عدم السماح باحتجاز المهاجرين المنتمين إلى فئات ضعيفة والمحتاجين إلى مساعدة خاصة إلا كتدبير يُلجأ إليه كملاذ أخير وينبغي أن توفر لهم المساعدة الطبية والنفسية المناسبة؛

(د) ضمان العمل دائماً على ألا يُستخدم احتجاز الأطفال ملتمسي اللجوء والأطفال المهاجرين، إلا كتدبير يُلجأ إليه كملاذ أخير ولأقصر فترة زمنية مناسبة، عملاً بأحكام المادة 37(ب) من الاتفاقية وعلى أن يخضع الاحتجاز لحدود زمنية ولمراجعة قضائية.

5. Encourages Member States to promote, inter alia, the use of alternative measures, such as diversion and restorative justice, to comply with the principle that deprivation of liberty of children should be used only as a measure of last resort and for the shortest appropriate period of time, and to avoid, wherever possible, the use of pretrial detention for children;
5- تشجِّع الدولَ الأعضاء على أن تقوم، في جملة أمور، بتعزيز استخدام تدابير بديلة مثل إحالة الجانحين إلى برامج إصلاح خارج نظام العدالة الجنائية والعدالة الإصلاحية، والتقيد بمبدأ وجوب عدم حرمان الأطفال من حرّيتهم إلاَّ كتدبير يُلجأ إليه كملاذ أخير ولأقصر فترة زمنية ممكنة والحرص، حيثما أمكن، على تفادي احتجاز الأطفال قبل المحاكمة؛

18. The text recognizes the importance of providing practitioners with a range of appropriate non-custodial measures, such as restorative justice, warning and community-based programmes so that deprivation of liberty is used only as a measure of last resort (see para. 31).
18- ويقر النص بأهمية تزويد الممارسين بمجموعة من التدابير غير الاحتجازية المناسبة، كالعدالة التصالحية والإنذار والبرامج المجتمعية، بحيث لا يتم اللجوء إلى الحرمان من الحرية إلا كتدبير يُلجأ إليه كملاذ أخير (انظر الفقرة 31).

(h) Ensuring that legislation does not allow for the detention of unaccompanied children and that detention of children is permitted only as a measure of last resort and only when it has been determined to be in the best interest of the child, for the shortest appropriate period of time and in conditions that ensure the realization of the rights enshrined in the Convention on the Rights of the Child.
(ح) ضمان أن لا يجيز التشريع احتجاز الأطفال غير المصحوبين وأن لا يجيز احتجاز الأطفال إلا كتدبير يُلجأ إليه كملاذ أخير وعندما يتقرر أن ذلك يخدم المصلحة الفضلى للطفل ولأقصر فترة ممكنة وفي ظروف تضمن تنفيذ الحقوق المنصوص عليها في اتفاقية حقوق الطفل.

Given the availability of alternatives to detention, it is difficult to conceive of a situation in which the detention of an unaccompanied minor would comply with the requirements stipulated in article 37 (b), clause 2, of the Convention on the Rights of the Child, according to which detention can be used only as a measure of last resort.
وبالنظر إلى توافر تدابير بديلة للاحتجاز، من الصعب تصور حالة يكون فيها احتجاز قاصر غير مصحوب متلائماً مع الشروط المنصوص عليها في المادة 37(ب)، البند 2 من اتفاقية حقوق الطفل والتي تنص على ألا يُمارس الاحتجاز إلا كتدبير يُلجأ إليه كملاذ أخير.

45. CAT recommended urgent measures to bring the conditions of detention in police stations, prisons and other detention facilities into line with the United Nations Standard Minimum Rules for the Treatment of Prisoners, in particular by reducing prison overcrowding, by ensuring that detention is only used as a measure of last resort; and by strengthening judicial supervision of conditions of detention.
45- وأوصت لجنة مناهضة التعذيب بأن تتخذ تدابير عاجلة تتيح مواءمة ظروف الاحتجاز في مراكز الشرطة والسجون ومرافق الاحتجاز الأخرى مع قواعد الأمم المتحدة النموذجية الدنيا لمعاملة السجناء، ولا سيما بالقيام بخفض اكتظاظ السجون، وضمان عدم استخدام الاحتجاز إلا كتدبير يُلجأ إليه كملاذ أخير وتعزيز المراقبة القضائية لظروف الاحتجاز(78).
