Non-Article 5 Parties to the Copenhagen and Beijing Amendments - as of 5 April 2004

First, the Parties would recognise that the term " State not Party to this Protocol " did not apply to Article 5 Parties until 2016, when they would have HCFC consumption and production control measures in effect, in accordance with the Copenhagen and Beijing Amendments.

Thatis discussion arose because, although the European Community had ratified the Copenhagen and Beijing Amendments, and most member Sstates had independently ratified both amendments, certain member Sstates had not independently ratified the Copenhagen and Beijing aAmendments or submitted the information called for under decision XV/3.

Recalling Decision XV/3 which clarifies the definition of States not party to this Protocol for the purposes of obligations of Parties to the Copenhagen and Beijing Amendments to the Montreal Protocol with respect to control measures on hydrochlorofluorocarbons (HCFCs),

Annex II to the presentis note contains a list of all non-Article 5 Parties and their status as Pparties or not to the Copenhagen and Beijing Amendments as of 31 March 2004 and the data submitted by some of them in response to paragraph 1(c) of decision XV/3.

The decision further defined the term " State not Party to the Protocol " to include all other States and regional economic integration organizations that had not agreed to be bound by the Copenhagen and Beijing Amendments (para. 1 (b) of decision XV/3).

It relates to the treatment of Parties not operating under Article 5 of the Protocol that have not ratified the Copenhagen and Beijing Amendments to the Protocol for the purpose of trade in hydrochlorofluorocarbons (HCFCs) as " State[s] not party to the Protocol " , as that term is used in decision XV/3 and in paragraph 9 of Article 4 of the Protocol.

In decision XV/3, the Parties decided that the term " State not party to this Protocol " in Article 4, paragraph 9 of the Convention Protocol would not apply to those States operating under Article 5, paragraph 1, of the Protocol until January 1, 2016, but would include all other States and regional economic integration organizations that had not agreed to be bound by the Copenhagen and Beijing Amendments.
