The Protocol established the possibility of inquiries in the case of grave or systematic violations by a State Party of any of the economic, social and cultural rights set forth in the Covenant.

Firstly, counsel argues that the Preamble to the Optional Protocol as well as its articles 1 and 2 all state that the Protocol gives competence to the Committee to receive and consider communications from individuals subject to the jurisdiction of a State party who claim to be victims of a violation by the State party of any of the rights set forth in the Covenant.

States accept the substantive rights of individuals by reference to the Covenant, and not the first Optional Protocol.
