Subparagraph (a) follows the substance of the OECD Model and proceeds on the basis that if a person with the authority to conclude contracts in the name of the enterprise creates for that enterprise a sufficiently close association with a State, then it is appropriate to deem that such an enterprise has a permanent establishment there.
