The deliberate and wilful violations of international law by the Government of Ethiopia is the most serious and persistent problem facing the peoples of Eritrea and Ethiopia, and this is what constitutes a major breach to the Algiers Peace Agreements.
إن الانتهاكات المتعمدة والمقصودة للقانون الدولي من قِبَل حكومة إثيوبيا هي أخطر وأشد المشاكل التي تواجه شعبْ إريتريا وإثيوبيا، وهذا ما يشكل خرقا جسيما لاتفاق الجزائر للسلام.

This happened in spite of the fact that the Council is the main guarantor of the Algiers Peace Agreement and has treaty obligations to maintain the integrity of the legal decision.

4. The Government of Eritrea again calls on the United Nations Security Council to redress the situation and ensure the removal of the Ethiopian occupation of Eritrean territories, which is in breach of the Algiers Peace Agreement and the Charter of the United Nations.

There is no need to beat around the bush: had Ethiopia not reneged on its commitment and had cooperated fully with the independent Boundary Commission, the issue between the two countries could have been resolved then and there, and the successful conclusion of the Algiers Peace Agreement would have brought the huge suffering of the two peoples to an end in no time.
فلا حاجة للمراوغة: ولو لم تتنكّر إثيوبيا لالتزاماتها، وتعاونت تعاوناً كاملاً مع لجنة الحدود المستقلة، لكانت المسألة قد حُلَّت بين البلدين آنذاك وهناك، ولكانت النتيجة الناجعة لاتفاق الجزائر للسلام قد أنهت سريعاً المعاناة الكبيرة للشعبين.

My Government has plainly and categorically made its views and position known on the appointment of the special envoy because we remain firmly convinced that such a course of action will, in addition to its negative legal ramifications, complicate and corrode altogether the final and binding nature of the decision of the Boundary Commission as well as key tenets of the Algiers Peace Agreement.

Ethiopia's gross violations of the Algiers Peace Agreement, and its supercilious obstruction of the Boundary Commission from performing its remaining tasks of demarcation warranted timely and effective punitive measures from the Security Council on the basis of Chapter VII of the Charter in order to secure its compliance with its treaty obligations.
وكانت الانتهاكات الجسيمة التي ارتكبتها إثيوبيا لاتفاق الجزائر للسلام فضلا عن عرقلتها المتسمة بالغطرسة لأداء لجنة الحدود لمهامها المتبقية المتمثلة في الترسيم، تستدعي اتخاذ تدابير عقابية في حينها وبصورة فعالة من جانب مجلس الأمن بناء على الفصل السابع من الميثاق لضمان امتثالها لالتزاماتها التعاهدية.

Gradually, the Security Council and the United States Government began to openly accommodate Ethiopia's violations of the Algiers Peace Agreement and even embraced the notions of " special envoys " to tamper with and supplant the Boundary Commission and its decisions.
وبالتدريج بدأ مجلس الأمن وحكومة الولايات المتحدة يعدلان مواقفهما علنا بالنسبة لانتهاكات إثيوبيا لاتفاق الجزائر للسلام بل واعتمدا أفكار " المبعوثين الخاصين " للتلاعب بقرارات لجنة الحدود واستبدالها.

Ethiopia's acts, which have been tolerated for the past six years by the Security Council, constitute a flagrant breach of the Algiers Peace Agreement and of Articles 2.4 and 33 of the Charter of the United Nations on the non-use of force against the territorial integrity of a Member State and the commitment of Member States to the pacific settlement of disputes.
وتشكل أعمال إثيوبيا، التي يتسامح معها مجلس الأمن على مدى السنوات الستة الماضية، خرقا صارخا لاتفاق الجزائر للسلام وللمادتين 2-4 و 33 من ميثاق الأمم المتحدة المتعلقتين بعدم استعمال القوة ضد سلامة أراضي أي دولة عضو والتزام الدول الأعضاء بتسوية المنازعات بالطرق السلمية.

Ethiopia's threat to reject the delimitation decision further constitutes a serious violation of the Algiers Peace Agreement (A/55/686-S/2000/1183, annex), which stipulates, explicitly, in article 4.15 that the decisions of the Boundary Commission are " final and binding " .
ويشكل كذلك تهديد إثيوبيا برفض قرار تخطيط الحدود انتهاكا جسيما لاتفاق الجزائر للسلام (A/55/686-S/2000/1183، المرفق)، الذي ينص صراحة في المادة 4-15 على أن قرارات لجنة الحدود " نهائية وملزمة " .

Early in July 2003, Ethiopia refused to respect Security Council resolution 1430 (2002) that expressly requested it to dismantle within 30 days the new settlements that it had created in the Dembe Mengul territory of Eritrea in violation of the Algiers Peace Agreement.

إن اقتراح إثيوبيا الطريف الداعي إلى " الاعتراف بالحدود الجنوبية للمنطقة الأمنية المؤقتة كحدود بين البلدين " إنما يمثل انتهاكا فادحا لاتفاق الجزائر للسلام ولقرارات مجلس الأمن ذات الصلة بالموضوع.
