Indeed, a stated purpose of the Protocol against the Smuggling of Migrants by Land, Sea and Air is to protect the rights of smuggled migrants and it limits the criminal liability of migrants found to be the object of interception efforts.
والواقع أنه من الأغراض الواضحة والصريحة لبروتوكول مكافحة تهريب المهاجرين عن طريق البر والبحر والجو حمايةُ حقوق المهاجرين المهرَّبين وهو يحدّ من المسؤولية الجنائية الواقعة على عاتق المهاجرين الذين يكونون هدفاً لجهود اعتراض السبيل في عرض البحر().

(b) Enacting and strengthening, as necessary, effective laws for the prevention and punishment of the smuggling of migrants, and measures for the support and protection of the rights of smuggled migrants and of witnesses in smuggling cases, in conformity with the Protocol against the Smuggling of Migrants by Land, Sea and Air, supplementing the United Nations Convention against Transnational Organized Crime;
(ب) سنّ وتعزيز قوانين فعالة، حسب الاقتضاء، لمنع تهريب المهاجرين والمعاقبة عليه، وتدابير لدعم وحماية حقوق المهاجرين المهرَّبين والشهود في قضايا التهريب، وفقا لبروتوكول مكافحة تهريب المهاجرين عن طريق البر والبحر والجو، المكمّل لاتفاقية الأمم المتحدة لمكافحة الجريمة المنظمة عبر الوطنية()؛

Good practice is for States parties to cooperate through the provision of appropriate human, technical and other resources as well as in building investigative capacity required to use specialist investigative techniques while protecting the rights of migrants in accordance with the Smuggling of Migrants Protocol.
وتتمثل الممارسة الجيِّدة في هذا الصدد في أن تتعاون الدول الأطراف من خلال توفير ما يلزم من موارد بشرية وتقنية وغيرها، بالإضافة إلى بناء قدرات التحرّي اللازمة لاستخدام تقنيات التحقيق المتخصصة مع حماية حقوق المهاجرين وفقا لبروتوكول مكافحة تهريب المهاجرين.

21- تُشجَّع الدول الأطراف على أن تتخذ تدابير مناسبة، عند الاقتضاء وبما يتسق مع التشريعات الداخلية، لإنشاء مراكز مشتركة بين عدة وكالات من أجل التنفيذ الفعَّال لبروتوكول مكافحة تهريب المهاجرين.

In its resolution 6/1 on ensuring effective implementation of the Organized Crime Convention and its Protocols, the Conference welcomed the substantive debate and activities carried out by the Working Group and underlined its contribution to the full implementation of the Smuggling of Migrants Protocol.
2- ورحَّب المؤتمر، في قراره 6/1 بشأن ضمان التنفيذ الفعَّال لاتفاقية الجريمة المنظَّمة والبروتوكولات الملحقة بها، بالمناقشات الموضوعية والأنشطة التي اضطلع بها الفريق العامل، ونوَّه بمساهمته في التنفيذ التام لبروتوكول مكافحة تهريب المهاجرين.

The number of parties having ratified the Convention against Transnational Organized Crime and the protocols thereto increased to 179 with 14 new ratifications during the biennium for the Convention, 159 with 12 new ratifications for the protocol against trafficking in persons, 138 with 9 new ratifications for the Protocol against the Smuggling of migrants and 107 with 17 new ratifications for the firearms protocol.
404 - خلال فترة السنتين، زاد عدد الأطراف المصدّقة على اتفاقية الجريمة المنظمة وبروتوكولاتها ليصبح هذا العدد بالنسبة للاتفاقية 179 طرفا، منها 14 طرفا جديدا، وبالنسبة لبروتوكول مناهضة الاتجار بالأشخاص 159 طرفا، منها 12 طرفا جديدا، وبالنسبة لبروتوكول مكافحة تهريب المهاجرين 138 طرفا، منها 9 أطراف جديدة، وبالنسبة لبروتوكول الأسلحة النارية 107 أطراف، منها 17 طرفا جديدا.

According to the Protocol against the Smuggling of Migrants by Land, Sea and Air, supplementing the United Nations Convention against Transnational Organized Crime,9 " smuggling of migrants " means the procurement, in order to obtain, directly or indirectly, a financial or other material benefit, of the illegal entry of a person into a State party of which the person is not a national or a permanent resident (article 3 (a)).
ووفقا لبروتوكول مكافحة تهريب المهاجرين عن طريق البر والبحر والجو المكمل لاتفاقية الأمم المتحدة لمكافحة الجريمة المنظمة عبر الحدود الوطنية(9) يعني تهريب المهاجرين " تدبير الدخول غير المشروع لأحد الأشخاص إلى دولة طرف لا يكون ذلك الشخص من مواطنيها أو المقيمين الدائمين فيها، وذلك من أجل الحصول بصورة مباشرة أو غير مباشرة على منفعة مالية أو منفعة مادية أخرى " (المادة 3 (أ)).

(a) Providing assistance for the promotion and ratification of and accession to all three Protocols to the Organized Crime Convention, with particular attention to the Protocol against the Smuggling of Migrants by Land, Sea and Air and the Protocol against the Illicit Manufacturing of and Trafficking in Firearms, Their Parts and Components and Ammunition;
(أ) تقديم المساعدة من أجل ترويج جميع البروتوكولات الثلاثة الملحقة باتفاقية مكافحة الجريمة المنظمة والتصديق على هذه البروتوكولات والانضمام إليها، مع إيلاء اهتمام خاص لبروتوكول مكافحة تهريب المهاجرين عن طريق البر والبحر والجو، وبروتوكول مكافحة صنع الأسلحة النارية وأجزائها ومكوناتها والذخيرة والاتجار بها بصورة غير مشروعة؛
