International Commission of Jurists (ICJ) noted the definition of torture under the Criminal Code did not encompass all the elements of torture as included in the CAT; and the penalties prescribed for the crime of torture were not commensurate with the gravity of the offence, as required by the CAT.
15- ولاحظت اللجنة الدولية لفقهاء القانون أن تعريف التعذيب في القانون الجنائي لا يشمل جميع العناصر المدرجة في اتفاقية مناهضة التعذيب؛ وأن العقوبات المنصوص عليها بالنسبة لجريمة التعذيب لا تتمشى مع خطورة الجريمة، على النحو الذي تقتضيه اتفاقية مناهضة التعذيب(29).

257. The World Organization against Torture (also on behalf of the Cairo Institute for Human Rights Studies, Human Rights Watch and the International Commission of Jurists) stated that Tunisia is capable of making progress, particularly legislative progress in the areas of the rights of the child and the status of women.
257- وقالت المنظمة العالمية لمناهضة التعذيب (التي تحدثت أيضاً باسم معهد القاهرة لدراسات حقوق الإنسان ومنظمة هيومن رايتس ووتش واللجنة الدولية لفقهاء القانون) إن تونس قادرة على إحراز تقدم، وبخاصة على صعيد التشريع، في مجال حقوق الطفل ومجال مركز المرأة.

22. Mr. Lozada (American Association of Jurists) said that his country had " self-government " , but without any basic powers: without authority to conduct trade with other countries, control its borders or communications media, decide on the use of its natural resources or the life and death of its youth, who participated in foreign wars imposed by the United States Government.
22 - السيد لوزادا (الرابطة الأمريكية لفقهاء القانون): قال إن بلده يتمتع " بالحكم الذاتي " ، ولكن دون سلطات أساسية: فبدون سلطة لإجراء التجارة مع البلدان الأخرى أو لمراقبة حدودها أو وسائط الاتصالات، وبدون سلطة للبت في استخدام مواردها الطبيعية أو الحياة والموت لشبابها الذين يشاركون في الحروب الخارجية المفروضة من حكومة الولايات المتحدة.

To that same end, the Working Group, which met before the fifty-seventh session, met representatives of non-governmental organizations (Amnesty International, International Association against Torture, International Commission of Jurists, International Federation of Human Rights, World Organization against Torture and International Service for Human Rights) to consider various methods of cooperation.

The Sub-Commission also heard statements by the representatives of the following non-governmental organizations: Afro-Asian People's Solidarity Organization (11th), American Association of Jurists (11th), Centre Europe-Tiers Monde (11th), International Educators for World Peace (10th), Movement against Racism and for Friendship among Peoples (9th).

Ms. Ramos (American Association of Jurists) said that her organization's objective was to work for the self-determination of peoples and against imperialism and colonialism, and it defended the Puerto Rican people's right to self-determination and independence in accordance with General Assembly resolution 1514 (XV) and denounced the resumption of military activity in Vieques by the United States Navy.
