1. Conditions of service for the judges of the International Criminal Tribunal for the Former Yugoslavia and the International Criminal Tribunal for Rwanda
١ - شروط الخدمة لقضاة المحكمة الجنائية الدولية ليوغوسلافيا السابقة والمحكمة الجنائية الدولية لرواندا.

The present report also addresses, in paragraphs 99 to 104 and 198 to 206, the special requests contained in General Assembly resolutions 51/231 of 13 June 1997 and 52/218 of 22 December 1997 concerning completion of the new Procurement Manual and ex gratia payments to judges of the International Criminal Tribunal for Rwanda.

Conditions of service and compensation of the judges of the International Criminal Court
شروط الخدمة والتعويضات لقضاة المحكمة الجنائية الدولية

As requested by the General Assembly in its resolution 52/218 of 22 December 1997, the Board of Auditors has reviewed the ex gratia payments of $750,663 to judges of the International Criminal Tribunal for Rwanda covering the period from 26 June 1995 to 18 June 1996.
١٩٨ - كما طلبت الجمعية العامة، في قرارها ٥٢/٢١٨ المؤرخ ٢٢ كانون اﻷول/ ديسمبر ١٩٩٧، استعرض مجلس مراجعي الحسابات اﻹكراميات المدفوعة لقضاة المحكمة الجنائية الدولية لرواندا التي تبلغ ٦٦٣ ٧٥٠ دولارا في الفترة من ٢٦ حزيران/يونيه ١٩٩٥ إلى ١٨ حزيران/يونيه ١٩٩٦.

3. Further decides to amend article 1 of the Pension Scheme Regulations for the judges of the International Criminal Tribunal for Rwanda and to replace that article with the provisions set out in annex III to the present resolution.
3 - تقرر كذلك تعديل المادة 1 من النظام الأساسي للمعاشات التقاعدية لقضاة المحكمة الجنائية الدولية لرواندا والاستعاضة عن تلك المادة بالأحكام المبينة في المرفق الثالث من هذا القرار.

3. Further decides to amend article 1 of the Pension Scheme Regulations for the judges of the International Criminal Tribunal for Rwanda and to replace that article with the provisions set out in annex III to the present resolution.
3 - تقرر كذلك تعديل المادة 1 من النظام الأساسي للمعاشات التقاعدية لقضاة المحكمة الجنائية الدولية لرواندا والاستعاضة عن تلك المادة بالأحكام المبينة في المرفق الثالث لهذا القرار.

(i) judges of the International Criminal Tribunal for the Former Yugoslavia shall, upon retirement, be entitled to receive a retirement pension as set forth in the draft pension scheme regulations for judges of the Tribunal, contained in annex IV to the present report.
`١` يحق لقضاة المحكمة الجنائية الدولية ليوغوسلافيا السابقة أن يتقاضوا عند التقاعد معاشا تقاعديا على النحو المحدد في مشروع النظام اﻷساسي لخطة المعاشات التقاعدية لقضاة المحكمة، الوارد في المرفق الرابع لهذا التقرير.

(i) judges of the International Criminal Tribunal for Rwanda shall, upon retirement, be entitled to receive a retirement pension as set forth in the draft pension scheme regulations for judges of the Tribunal contained in annex V to the present report.
`١` يحق لقضاة المحكمة الجنائية الدولية لرواندا أن يتقاضوا عند التقاعد معاشا تقاعديا على النحو المحدد في مشروع النظام اﻷساسي لخطة المعاشات التقاعدية لقضاة المحكمة والوارد في المرفق الخامس لهذا التقرير.

1-9 June 1998: - I attended the Fifth Plenary Session of the judges of the International Criminal Tribunal for Rwanda (ICTR) including those of the Appeals Chamber from The Hague.
1-9 حزيران/يونيه 1998: - حضرت الدورة العامة الخامسة لقضاة المحكمة الجنائية الدولية لرواندا، بما في ذلك قضاة دائرة الاستئناف القادمين من لاهاي.

In addition, the Board addressed the special requests contained in General Assembly resolutions 51/231 of 13 June 1997 and 52/218 of 22 December 1997 concerning completion of the new Procurement Manual and ex gratia payments to judges of the International Criminal Tribunal for Rwanda.

The Administration informed the Board, in line with rule 110.13, that ex gratia payments totalling $787,892.54 were made to 15 individuals during the biennium 1996-1997, including payments made to judges of the International Criminal Tribunal for Rwanda.
٧٢ - أبلغت اﻹدارة المجلس أنه، تمشيا مع القاعدة ١١٠-١٣ من النظام المالي، دفعت إكراميات مجموعها ٨٩٢,٥٤ ٧٨٧ دولار إلى ١٥ شخصا في أثناء فترة السنتين ١٩٩٦-١٩٩٧، بما في ذلك المبالغ المدفوعة لقضاة المحكمة الجنائية الدولية لرواندا.

(g) Revisions. Whenever the conditions of service of the members of the International Court of Justice are revised by the General Assembly, where applicable the conditions established hereby for the judges of the International Criminal Tribunal for the Former Yugoslavia shall be revised accordingly.

The Advisory Committee was expected to adopt its reports relating to the financing of the United Nations Interim Force in Lebanon (UNIFIL) and the conditions of service of judges of the International Criminal Tribunal for Rwanda (ICTR) during the week commencing 4 December.
وأضاف أن من المتوقع أن تعتمد اللجنة الاستشارية تقاريرها المتصلة بتمويل قوة الأمم المتحدة المؤقتة في لبنان وشروط الخدمة لقضاة المحكمة الجنائية الدولية لرواندا أثناء الأسبوع الذي يبدأ يوم 4 كانون الأول/ديسمبر.

16. The Advisory Committee notes that, under option 2 of the Secretary-General's report this option, the annual salaries of members of the ICJ Court and the judges of the ITYInternational Tribunal for the Former Yugoslavia would be $274,744 and that the annual salaries of the judges of the International Criminal Tribunal of for Rwanda would be $239,534.
16 - وتلاحظ اللجنة الاستشارية أنه، وفقا لهذا الخيار، ستصل المرتبات السنوية لأعضاء محكمة العدل الدولية وقضاة المحكمة الدولية ليوغوسلافيا السابقة إلى 744 274 دولارا وستصل المرتبات السنوية لقضاة المحكمة الجنائية الدولية لرواندا إلى 534 239 دولارا.

39. In its report of 6 December 2001 (A/56/7/Add.2, para. 9), the Advisory Committee indicated that it had " no objection to the proposed change in the home leave travel of the judges of the International Criminal Tribunal for Rwanda to take account of the hardship classification of the duty station " .
39 - أشارت اللجنة الاستشارية في تقريرها المؤرخ 6 كانون الأول/ديسمبر 2001 (A/56/7/Add.2، الفقرة 9) إلى أن ' ' ليس لديها أي اعتراض على التغيير المقترح في إجازة زيارة الوطن لقضاة المحكمة الجنائية الدولية لرواندا العاملين في أروشا بحيث يأخذ في الاعتبار تصنيف مركز العمل حسب درجة المشقة``.

The Committee was informed that the pension scheme for the judges of the International Criminal Court had been modified in 2007.
وأُبلغت اللجنة أن نظام المعاشات التقاعدية لقضاة المحكمة الجنائية الدولية عدل في عام 2007.

The pension scheme regulations of the ICC judges are thus being amended to read as follows:

The Advisory Committee notes that, under the second option, the annual salaries of members of the Court and the judges of the International Tribunal for the Former Yugoslavia would be $274,744 and that the annual salaries of the judges of the International Criminal Tribunal for Rwanda would be $239,534.
