V. Privileges and immunities of the judges of the Tribunals

In its resolutions 52/217 and 52/218, both of 22 December 1997, the Assembly decided to defer consideration of the conditions of the pension entitlements for the judges of the two Tribunals until the next review of the conditions of service of the members of the Court.

For all those reasons, the Council requests the Assembly to accord business-class travel to the judges of both Tribunals.

III. Background information on the pension benefits of the judges of the Tribunals

(j) Pensions in payment should also be adjusted on the occasion of increases in the annual net base salary of the judges of the Tribunals.

18. The Secretary-General would also recall some principles which he deems should be taken into consideration in arriving at a revised system for calculating the pensions of the members of the International Court of Justice and, in turn, the judges of the Tribunals.

53. In its resolution 53/214, the General Assembly approved the travel and subsistence regulations for the judges of the Tribunals contained in annex III to the report of the Secretary-General (A/52/520).

55. The Secretary-General notes that the Organization has made provisions for the judges of the Tribunals, upon their appointment, to participate in an appropriate United Nations medical insurance plan in accordance with the relevant administrative rules and procedures, at full premium.

The Secretary-General thus proposed that the conditions of service approved by the Assembly for the judges of the Tribunals and the travel and subsistence regulations for the judges of the Tribunals contained in annex III to document A/52/520 be applied to the ad litem judges.

Mr. Mselle (Chairman of the Advisory Committee on Administrative and Budgetary Questions) introduced the Advisory Committee’s report on conditions of service for the judges of the two Tribunals and the 1998 budget estimates for the International Tribunal for the Former Yugoslavia (A/52/696) and its report on the 1998 budget estimates for the International Criminal Tribunal for Rwanda (A/52/697).

The pension benefit for the judges of the two Tribunals would be based on that applicable to the judges of the Court, prorated to account for the difference in length in the terms of appointment, that is to say, nine years for the members of the Court versus four years for the judges of both Tribunals.

8. In section VIII of its resolution 53/214 of 18 December 1998, the General Assembly approved revisions to the conditions of service and compensation for the members of the International Court of Justice, and at the same time adopted the pension scheme regulations for the judges of both Tribunals.
