With regard to interest, the court took the majority position, on the basis of CISG article 78 and the digest of case law on the Convention, that the issue was outside the scope of the Convention and that there appeared to be a clear trend to apply the rate that would be applicable according to the rules of private international law if the Convention were not applicable.

Although the article does not refer to the " applicable " law, it is understood, in the light of criteria used to define the geographic field of application of the Convention, that the " law " referred to in this article is the law that applies to the dealings between the parties in accordance with the relevant rules of private international law.

When ICAC had made the contested award, it had indicated that, when issues arose over the provisions of the Convention that could not be resolved under the Convention itself, they should be settled by reference to the general principles on which the Convention was founded or, in the absence of such principles, by reference to the law that was applicable according to the rules of private international law.

The fact that the substantive secured transactions law of a State might not apply to those other transactions should not preclude the State from applying to those transactions the private international law rules applicable to secured transactions.

Apart from that question, the court also held that, as the CISG does not provide rules on the validity of an exemption clause, this must be decided by recourse to the national law that is found to be applicable according to private international law rules.

71- وفقا لقواعد القانون الدولي الخاص المنطبقة عموما، لا يجوز للمحكمة أن ترفض تطبيق القانون المنطبق بمقتضى قواعد القانون الدولي الخاص التي تعمل بها إلا إذا كان أثر هذا التطبيق مخالفا بوضوح للسياسة العامة لدولة المحكمة أو حيثما كان هذا الأثر مخالفا للأحكام الإلزامية لقانون دولة المحكمة.
