أولهما، إعداد القواعد اﻹجرائية لﻹعسار عبر الحدود وهو اﻷمر الذي يمكن أن يتناول التعاون القضائي الدولي والاعتراف باﻹجراءات الخارجية والتنسيق بينها، وإمكانية وصول الممثلين اﻷجانب.

Convinced of the desirability, in the interpretation of those provisions, of regard to the international origin of the Model Law on Cross-Border Insolvency and the need to promote uniformity in its application,

48. The note also reported on the preparation of a digest of case law on the UNCITRAL Model Law on Cross-Border Insolvency.

That text had drawn upon material contained in the UNCITRAL Model Law on Cross-Border Insolvency: the Judicial Perspective, adopted by the Commission in 2011.

75. He agreed that the UNCITRAL Model Law on Cross-Border Insolvency should govern foreign insolvency proceedings, which were becoming more and more frequent in an increasingly global economy.

It was noted that recommendation (35)(a) was derived from, but did not mirror Article 23 of the Model Law on Cross-Border Insolvency.
