34- توصي اللجنة الدولة الطرف بالنظر في اعتماد أحكام قانونية محددة لحظر بيع الأسلحة أو نقلها إذا كانت وجهتها الأخيرة بلد يحتمل أن يتعرض فيه الأطفال أو يتعرضون فيه بالفعل للتجنيد أو الاستخدام في الأعمال القتالية.

وإذ تعترف بالاحتياجات الخاصة للأطفال المعرضين بصورة خاصة للتجنيد أو الاستخدام في الأعمال الحربية بما يخالف هذا البروتوكول نظراً لوضعهم الاقتصادي أو الاجتماعي أو نظراً لجنسهم،

• ويحدد البروتوكولان الإضافيان لاتفاقيات جنيف الأربع لسنة 1949 (1977) سن خمسة عشر عاما كحد أدنى للتجنيد أو الاستخدام في النزاع المسلح.

(g) The programmes (e.g. birth registration campaigns) to prevent children who are at highest risk of recruitment or use by armed groups, such as refugee and internally displaced children, street children, orphans, from being so recruited or used.
(ز) البرامج (مثل حملات تسجيل الولادات) الرامية إلى منع تجنيد أو استخدام أكثر الأطفال عرضة للتجنيد أو الاستخدام من جانب المجموعات المسلحة، مثل الأطفال اللاجئين والمشردين داخلياً، وأطفال الشوارع، والأيتام.

(c) Ensure the greatest transparency regarding the transfer of arms and explicitly prohibit in law the sale of arms when there is risk that the final destination is a country where children are, or potentially could be, recruited or used in hostilities.
(ج) ضمان توخي قدر أكبر من الشفافية فيما يتعلق بنقل الأسلحة وحظر بيعها صراحة بموجب القانون عندما تكون وجهتها الأخيرة هي أحد البلدان الذي يحتمل أن يتعرض فيه الأطفال أو يتعرضون فيه بالفعل للتجنيد أو الاستخدام في الأعمال القتالية.
