4.11 The State party further claims that the communication is inadmissible for failure to substantiate violations of Covenant rights.
٤-١١ وتدعي الدولة الطرف كذلك أن البلاغ غير مقبول لعدم إقامته اﻷدلة على حدوث انتهاكات للحقوق المشمولة بالعهد.

Accordingly, where public officials or State agents have committed violations of the Covenant rights referred to in this paragraph, the States parties concerned may not relieve perpetrators from personal responsibility, as has occurred with certain amnesties (see general comment No. 20 (44)) and prior legal immunities and indemnities.
وتبعاً لذلك، وحيثما يرتكب الموظفون العموميون أو وكلاء الدولة انتهاكات للحقوق المشمولة بالعهد والمشار إليها في هذه الفقرة، لا يجوز للدول الأطراف أن تعفي مرتكبي هذه الانتهاكات من المسؤولية الشخصية مثلما حدث في بعض حالات العفو (انظر التعليق العام رقم 20(44)) والحصانات القانونية المسبقة.

The Committee invites those States parties in which the Covenant does not form part of the domestic legal order to consider incorporation of the Covenant to render it part of domestic law to facilitate full realization of Covenant rights as required by article 2.
وتدعو اللجنة تلك الدول الأطراف التي لا يشكل فيها العهد جزءاً من النظام القانوني المحلي إلى النظر في إدماج العهد من أجل جعله جزءاً من القانون المحلي بغية تيسير الإعمال الكامل للحقوق المشمولة بالعهد حسبما تقتضيه المادة 2.

8.3 The Committee recalls that State parties have a positive obligation to ensure the protection of individuals against violations of Covenant rights, which may be committed not only by its agents, but also by private persons or entities.
8-3 وتشير اللجنة إلى أنّ على الدولة الطرف التزاماً إيجابياً بأن توفر الحماية للأفراد لا مما قد يرتكبه أعوانها من انتهاكات للحقوق المشمولة بالعهد فحسب، وإنما أيضاً من الأفعال التي يقوم بها أفراد عاديون أو تقوم بها كيانات خاصة().

However the positive obligations on States parties to ensure Covenant rights will only be fully discharged if individuals are protected by the State, not just against violations of Covenant rights by its agents, but also against acts committed by private persons or entities that would impair the enjoyment of Covenant rights insofar as they are amenable to application between private persons or entities.
إلا أن الالتزامات الإيجابية الملقاة على عاتق الدول الأطراف بأن تضمن الحقوق المشمولة بالعهد لا يمكن أن تؤدى بالكامل إلا إذا وفرت الدولة الحماية للأفراد لا مما يرتكبه وكلاؤها من انتهاكات للحقوق المشمولة بالعهد فحسب، وإنما أيضاً من الأفعال التي يقوم بها أفراد عاديون أو كيانات خاصة والتي يمكن أن تعوق التمتع بالحقوق المشمولة بالعهد بقدر ما تكون هذه قابلة للتطبيق بين الخواص من الأفراد أو الكيانات.

36. General Comment 31 of the Human Rights Committee confirms that under the International Covenant on Civil and Political Rights " the positive obligations on States parties to ensure Covenant rights will only be fully discharged if individuals are protected by the State, not just against violations of Covenant rights by its agents, but also against acts committed by private persons or entities " .
36 - ويؤكد التعليق العام 31 للجنة المعنية بحقوق الإنسان أنه بموجب العهد الدولي الخاص بالحقوق المدنية والسياسية " فإن الالتزامات الإيجابية الملقاة على عاتق الدول الأطراف بأن تضمن الحقوق المشمولة بالعهد لا يمكن أن تؤدى بالكامل إلا إذا وفرت الدولة الحماية للأفراد لا مما يرتكبه وكلاؤها من انتهاكات للحقوق المشمولة بالعهد فحسب، وإنما أيضاً من الأفعال التي يقوم بها أفراد عاديون أو كيانات خاصة " ().

It confirms that under the ICCPR " the positive obligations on States parties to ensure Covenant rights will only be fully discharged if individuals are protected by the State, not just against violations of Covenant rights by its agents, but also against acts committed by private persons or entities " .
