With regard to legal implications, the Secretary/CEO indicated that the practice of the Fund has been to consider that a beneficiary is an individual who is in receipt of a periodic monthly benefit from the Fund and no resources have ever been disbursed to former participants who were not beneficiaries.

Moreover, any limits expressed in terms of length of service or of linking remuneration to amounts received as pensions might not be fair or equitable to former participants with small pensions (whether due to few years of contributory service or to relatively low levels of pensionable remuneration, or both).

The Pension Fund secretariat had decided that the sums credited to the USSR State budget should be returned and that the pension rights of the former participants in the Fund should be re-established in full.

266. Another suggestion advanced would replace or negate the proposed agreement by an undertaking from the Russian Government to adjust the national pension/social security benefits of the former participants, through direct payments to the former participants by the Government.
٢٦٦ - وثمة اقتراح آخر يستعيض عن/أو يبطل الاتفاق المقترح بتعهد من الحكومة الروسية بتعديل استحقاقات المعاش التقاعدي الوطني/الضمان الاجتماعي للمشتركين السابقين عن طريق مدفوعات مباشرة تسددها الحكومة إلى المشتركين السابقين.

126. The Standing Committee in 2001 requested that the Fund secretariat prepare a comprehensive, action-oriented paper covering all possible avenues for the utilization of the Emergency Fund, special restoration provisions and any other remedial actions that could be considered helpful to the former participants.

Mrs. Matvienko indicated that the practice had been to award individual pensions to the former participants concerned; however, with the abolition of individual pensions in the Russian Federation, with effect from 1 January 1992, these former participants of UNJSPF had been transferred to State pensions established by the law of the Russian Federation on 20 November 1990.
