In 1997 the National Conventional Arms Control Act Committee (NCACC) initiated a drafting process for a new Conventional Arms Control Bill in order to obtain the legal statutory authority to control conventional arms and services.

The Act prohibits a natural person who is a South African citizen or is permanently resident in the Republic, a juristic person registered or incorporated in the Republic, and any foreign citizen within the borders of the Republic from rendering foreign military assistance without authorisation from the National Conventional Arms Control Committee (NCACC).

31. Under section 4 of the Act, any person or company seeking to provide foreign military assistance is required to obtain authorization from the National Conventional Arms Control Committee, a Cabinet committee comprising eight ministers and three deputy ministers appointed by the President that was initially established in 1995 to deal with applications for arms sales.

In accordance with resolution 1572 (2004), under Chapter VII of the United Nations Charter, NCACC has instructed the Directorate of Conventional Arms Control, its implementing body, to undertake the necessary steps to withdraw any existing permits and to implement the arms embargo with immediate effect.

61. In enacting the Prohibition of Mercenary Activities and Regulation of Certain Activities in Country of Armed Conflict Act (No. 27 of 2006), South Africa sought to close those loopholes by requiring permission for the rendering of military assistance or security services to countries that have been declared " regulated " by the President on the recommendation of the National Conventional Arms Control Committee.
61- وجنوب أفريقيا، بسنّها القانون المتعلق بحظر أنشطة المرتزقة وتنظيم أنشطة معينة في بلد يواجه نزاعاً مسلحاً (القانون 27 لعام 2006)، سعت لسدّ هذه الثغرات باشتراط الحصول على ترخيص من أجل تقديم مساعدة عسكرية أو خدمات أمنية إلى بلدان أعلنها رئيس الدولة بوصفها " مشمولة بهذا القانون " بناءً على توصية اللجنة الوطنية لمراقبة الأسلحة التقليدية.

It went on to invite " African States to massively accede to this Convention in order to strengthen their contribution to the building and consolidation of International Humanitarian Law, particularly the formulation of international rules for the control of conventional weapons " .

Renewed efforts are also required to provide system-wide support for the process of disarmament, including verification, and to give new impetus to controlling conventional weapons and arms trafficking, and curbing the production and spread of landmines with a view to their ultimate banning;
