54- وهذه الاستنتاجات المتعلقة بمعنى " الخسارة المباشرة " لا تستهدف حسم كل مسألة قد تنشأ فيما يخص تفسير هذا الفريق لمقرري مجلس الإدارة 7 و9 بل الغرض منها هو أن تكون معايير أولية لاستعراض وتقييم المطالبات.

In the light of the above analysis, and in conformity with the two Governing Council decisions cited above, this Panel requires the following from those construction and engineering claimants that seek to recover for lost profits. First, the phrase " continuation of the contract " imposes a requirement on the claimant to prove that it had an existing contractual relationship at the time of the invasion.
149- وفي ضوء التحليل الوارد أعلاه، ووفقاً لمقرري مجلس الإدارة السالفي الذكر، يطلب هذا الفريق إلى أصحاب المطالبات في قطاع البناء والأشغال الهندسية الذين يطلبون استرداد ما فاتهم من كسب ما يلي: أولاً تفرض عبارة " استمرار العقد " على المطالب شرط إثبات أنه كان مرتبطاً بعلاقة تعاقدية قائمة وقت الغزو.
