1- تتخذ كل دولة طرف إجراءات تشريعية أو إدارية فعالة أو أية إجراءات أخرى لمنع أعمال التعذيب في أي إقليم يخضع لاختصاصها القضائي.

The Committee drew the State party's attention, in particular, to article 2, paragraph 1, of the Convention, according to which each State party shall take effective legislative, administrative, judicial or other measures to prevent acts of torture in any territory under its jurisdiction.

68. Under article 2 of the Convention against Torture, all States parties are required to take effective legislative, administrative, judicial or other measures to prevent acts of torture in any territory under their jurisdiction.
68 - وبموجب المادة 2 من اتفاقية مناهضة التعذيب، يطلب إلى جميع الدول الأطراف أن تتخذ تدابير تشريعية، وإدارية وقضائية أو غيرها من التدابير الفعالة لمنع أعمال التعذيب في أي من الأراضي الواقعة تحت ولايتها.

75. The Special Rapporteur welcomes the recent entry into force of the Optional Protocol to the Convention against Torture and reminds States parties to the Convention of their obligation under its article 2 to take effective measures to prevent acts of torture in any territory under their jurisdiction.
75 - ويرحب المقرر الخاص بدخول البروتوكول الاختياري لاتفاقية مناهضة التعذيب حيز النفاذ. وهو يذكّر الدول الأطراف في الاتفاقية بالتزاماتها بموجب المادة 2 بأن تتخذ إجراءات فعالة لمنع أعمال التعذيب في أي من الأقاليم التابعة لولايتها.

19. Under article 2 of the Convention, States parties shall enact " effective legislative, administrative, judicial or other measures to prevent acts of torture in any territory under its jurisdiction. "
19- يجب على الدول الأطراف، بموجب المادة 2 من الاتفاقية، أن تتخذ " إجراءات تشريعية أو إدارية أو قضائية فعالة أو أية إجراءات أخرى لمنع أعمال التعذيب في أي إقليم يخضع لاختصاصها القضائي " .

3.3 The complainant also invokes article 2, paragraph 1, of the Convention, pursuant to which the State party should have taken all " effective legislative, administrative, judicial or other measures to prevent acts of torture in any territory under its jurisdiction " .
3-3 وتحتج صاحبة الشكوى أيضاً بالفقرة 1 من المادة 2 من الاتفاقية، التي كان على الدولة الطرف بمقتضاها اتخاذ جميع " الإجراءات التشريعية أو الإدارية أو القضائية الفعالة أو أية إجراءات أخرى لمنع أعمال التعذيب في أي إقليم يخضع لاختصاصها القضائي " .

6-4 وتحتج صاحبة الشكوى أيضاً بالفقرة 1 من المادة 2 من الاتفاقية، التي كان على الدولة الطرف بمقتضاها أن تتخذ جميع " الإجراءات التشريعية أو الإدارية أو القضائية الفعالة أو أية إجراءات أخرى لمنع أعمال التعذيب في أي إقليم يخضع لاختصاصها القضائي " .

Article 2, paragraph 1, of the Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment -- to which all States parties to the Optional Protocol must also be parties -- provides that, " Each State Party shall take effective legislative, administrative, judicial or other measures to prevent acts of torture in any territory under its jurisdiction " .
وتنص الفقرة 1 من المادة 2 من الاتفاقية، التي ينبغي لجميع الدول الأطراف في البروتوكول الاختياري أن تنضم إليها أيضاً، على واجب أن " تتخذ كل دولة طرف إجراءات تشريعية أو إدارية أو قضائية فعالة أو أية إجراءات أخرى لمنع أعمال التعذيب في أي إقليم يخضع لاختصاصها القضائي " .

Article 2, paragraph 1, of the Convention, to which all States Parties to the Optional Protocol must also be parties, provides that " Each State Party shall take effective legislative, administrative, judicial or other measures to prevent acts of torture in any territory under its jurisdiction " .
وتنص الفقرة 1 من المادة 2 من الاتفاقية، التي ينبغي لجميع الدول الأطراف في البروتوكول الاختياري أن تنضم إليها أيضاً، على واجب أن " تتخذ كل دولة طرف إجراءات تشريعية أو إدارية أو قضائية فعالة أو أية إجراءات أخرى لمنع أعمال التعذيب في أي إقليم يخضع لاختصاصها القضائي " .

16. With regard to article 2 of the Convention, under which each State party has an obligation to take effective legislative, administrative, judicial or other measures to prevent acts of torture in any territory under its jurisdiction, acts of torture were already prohibited in the Kingdom's judicial and administrative legislation, as can be seen from the following:
16- إن ما تضمنته المادة 2 من الاتفاقية وهو " اتخاذ كل دولة طرف إجراءات تشريعية أو إدارية أو قضائية فعالة أو أية إجراءات أخرى لمنع أعمال التعذيب في أي إقليم يخضع لاختصاصها القضائي " مقررة في تشريع المملكة من قبل هذا النص ويتمثل في التشريعات القضائية والإدارية التي تمنع التعذيب في المملكة العربية السعودية، وأهمها:

Progress can be achieved in this area through " effective legislative, administrative, judicial or other measures to prevent acts of torture in any territory under its jurisdiction " (art. 2, para. 1, of the Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment, which applies to all signatories to the Optional Protocol).

Finally, the Special Rapporteur reminds States parties to the Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment of its article 2 which provides that " each State party shall take effective legislative, administrative, judicial or other measures to prevent acts of torture in any territory under its jurisdiction " .
وأخيراً، يود المقرر الخاص أن يُذكِّر الدول الأطراف في اتفاقية مناهضة التعذيب وغيره من ضروب المعاملة أو العقوبة القاسية أو اللاإنسانية أو المهينة، التي تنص في المادة 2 منها على أن " تتخذ كل دولة طرف إجراءات تشريعية أو إدارية أو قضائية فعالة أو أية إجراءات أخرى لمنع أعمال التعذيب في أي إقليم يخضع لاختصاصها القضائي " .

35. The Special Rapporteur would like to remind States parties to the Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment of its article 2 which provides that " each State party shall take effective legislative, administrative, judicial or other measures to prevent acts of torture in any territory under its jurisdiction " .
35- ويود المقرر الخاص أن يُذكِّر الدول الأطراف في اتفاقية مناهضة التعذيب وغيره من ضروب المعاملة أو العقوبة القاسية أو اللاإنسانية أو المهينة، التي تنص في المادة 2 منها على أن " تتخذ كل دولة طرف إجراءات تشريعية أو إدارية أو قضائية فعالة أو أية إجراءات أخرى لمنع أعمال التعذيب في أي إقليم يخضع لاختصاصها القضائي " .
