(a) Any criteria that the procurement regulations or other provisions of law of this State authorize or require to be taken into account;

1. Suppliers or contractors shall be permitted to participate in procurement proceedings without regard to nationality, except where the procuring entity decides to limit participation in procurement proceedings on the basis of nationality on grounds specified in the procurement regulations or other provisions of law of this State.
1- يُسمح للموَرِّدين أو المقاولين بالمشاركة في إجراءات الاشتراء بصرف النظر عن جنسياتهم، باستثناء الحالات التي تقرّر فيها الجهةُ المشترية أن تحدّ من المشاركة في إجراءات الاشتراء على أساس الجنسية، لأسباب محدَّدة في لوائح الاشتراء أو في أحكام أخرى من قانون هذه الدولة.

These requirements and measures would be authorized by the procurement regulations or other provisions of law of the enacting States only in procurement involving classified information and only with respect to that type of information, not any other information that the procuring entity may choose to protect at its own discretion.
وهذه الاشتراطات والتدابير لا تأذن بها لوائح الاشتراء أو غيرها من الأحكام القانونية لدى الدول المشترعة سوى في الاشتراء الذي ينطوي على معلومات سرّية وفيما يخص حصراً ذلك النوع من المعلومات وليس أيّ معلومات أخرى قد تختار الجهة المشترية حمايتها وفق صلاحيتها التقديرية.

1. The procurement regulations or other provisions of law of the enacting State must set out the exceptional conditions under which the procuring entity may limit the participation of certain categories of suppliers or contractors in procurement proceedings.
1- يجب أن تبين لوائح الاشتراء أو أحكام أخرى من قانون الدولة المشترعة الأحوال الاستثنائية التي يجوز فيها للدولة المشترعة أن تحدّ من مشاركة فئات معينة من المورِّدين أو المقاولين في إجراءات الاشتراء.

" Procurement in which the procuring entity may be authorized by the procurement regulations or by other provisions of law of this State to take measures and impose requirements for the protection of classified information. "
" الاشتراء الذي يجوز فيه، بمقتضى لوائح الاشتراء أو غيرها من أحكام قانون هذه الدولة، أن يُؤذَن للجهة المشترية بأن تتخذ تدابير وتفرض اشتراطات من أجل حماية المعلومات السرية. "

" Environmental, social, economic and other policies of this State authorized or required by the procurement regulations or other provisions of law of this State to be taken into account by the procuring entity in the procurement proceedings. "
" السياسات البيئية والاجتماعية والاقتصادية وغيرها من سياسات هذه الدولة التي تأذن أو تشترط لوائح الاشتراء أو غيرها من أحكام قانون هذه الدولة أن تضعها الجهة المشترية في الاعتبار في إجراءات الاشتراء. "

As stated in section II.B above, the authority granted to procuring entities to take special measures and impose special requirements for the protection of classified information applies only to the extent permitted by the procurement regulations or by other provisions of law of the enacting State;

8. The procurement regulations should therefore guide the procuring entity in selecting the maximum duration of a particular framework agreement within the maximum established in the procurement regulations or alternatively they may themselves establish different maximums for different types of procurement.
8- ومن ثمّ، ينبغي للوائح الاشتراء أن توجِّه الجهة المشترية في اختيار أقصى مدة لأي اتفاق إطار محدد ضمن المدة القصوى المحددة في لوائح الاشتراء أو تحدد بدلا من ذلك هي نفسها مددا قصوى مختلفة من أجل أنواع الاشتراء المختلفة.

(l) " Procurement involving classified information " means procurement in which the procuring entity may be authorized by the procurement regulations or by other provisions of law of this State to take measures and impose requirements for the protection of classified information;
(ﻫ) " الاشتراء المنطوي على معلومات سريّة " يعني الاشتراءَ الذي يجوز فيه، بمقتضى لوائح الاشتراء أو غيرها من أحكام قانون هذه الدولة، أن يُؤذن للجهة المشترية بأن تتخذ تدابير وتفرض اشتراطات من أجل حماية المعلومات السريّة؛

The procurement or other applicable regulations must provide or call for issuance of rules of procedure and guidance for the operation of the independent body, including:
ويجب على لوائح الاشتراء أو غيرها من اللوائح المنطبقة أن تنص على إصدار القواعد الإجرائية والإرشادات الخاصة بعمل الهيئة المستقلة أو أن تدعو إلى إصدار تلك القواعد والإجراءات، بما في ذلك:

1. The procurement or other applicable regulations must provide or call for issuance of detailed guidance on operation of the provisions of article 64 consistent with the legal and administrative structure of the enacting State.
1- يجب على لوائح الاشتراء أو غيرها من اللوائح المنطبقة أن تنص على إصدار إرشادات تفصيلية بشأن إعمال أحكام المادة 64 بالاتساق مع الهيكل القانوني والإداري للدولة المشترعة أو أن تدعو إلى ذلك.

It would be appropriate therefore for the procurement or other applicable regulations to refer to other provisions of law of the enacting State that set out the relevant authority and court procedures, so that both the procuring entities and suppliers and contractor has the complete picture as regards available remedies.
ولذلك من المناسب أن تحيل لوائح الاشتراء أو غيرها من اللوائح المنطبقة إلى الأحكام الأخرى لقانون الدولة المشترعة التي تحدد السلطة ذات الصلة وإجراءات المحكمة، بحيث تكون الجهات المشترية والمورِّدون والمقاولون على علم تام بالتدابير الانتصافية المتاحة.

4. The procurement or other applicable regulations must clarify whether an independent body may take a decision on lifting the prohibition without a request from a procuring entity.
4- ويجب على لوائح الاشتراء أو غيرها من اللوائح المنطبقة أن توضح ما إذا كان يجوز لجهة مستقلة أن تتخذ قرارا بشأن رفع الحظر دون أن تتلقى طلبا من الجهة المشترية.

2. The procurement or other applicable regulations are to elaborate on differences between the debriefing discussed in the context of article 22 above and a formal request for reconsideration before the procuring entity.
2- ويتعيَّن على لوائح الاشتراء أو غيرها من اللوائح المنطبقة أن توضح الفروق بين الرد على الاستفسارات الذي تمت مناقشته في المادة 22 أعلاه والطلب الرسمي بإعادة النظر لدى الجهة المشترية.

3. The procurement or other applicable regulations must explain the term the " participants in the challenge proceedings " as compared to " participants in the procurement proceedings " .
3- ويجب على لوائح الاشتراء أو غيرها من اللوائح المنطبقة أن توضح تعبير " المشاركين في إجراءات الاعتراض " مقارنةً بتعبير " المشاركين في إجراءات الاشتراء " .
