Whereas paragraph (1) refers to a restriction on the ground of nationality, paragraph (2) is open-ended as regards the nature of the grounds that may be found in the procurement regulations or other provisions of law of the enacting State.

For these reasons, these criteria should be treated as exceptional, as recognized by the requirement that their application be subject to a distinct requirement -- that they must be authorized or required for application under the procurement regulations or other provisions of law of the enacting State.

The Model Law leaves the issue to be addressed by procurement or other appropriate regulations.

(1) Suppliers or contractors shall be permitted to participate in procurement proceedings without regard to nationality, except where the procuring entity decides to limit participation in procurement proceedings on the basis of nationality on grounds specified in the procurement regulations or other provisions of law of this State.
(1) يُسمح للمورِّدين أو المقاولين بالمشاركة في إجراءات الاشتراء بصرف النظر عن جنسياتهم، باستثناء الحالات التي تقرّر فيها الجهةُ المشترية أن تحدّ من المشاركة في إجراءات الاشتراء على أساس الجنسية، لأسباب محدَّدة في لوائح الاشتراء التنظيمية أو وفقاً لأحكام أخرى من قانون هذه الدولة.

(a) Any criteria that the procurement regulations or other provisions of law of this State authorize or require to be taken into account;
(أ) أيَّ معايير يكون أخذها في الاعتبار مأذوناً به أو مشترطاً في لوائح الاشتراء التنظيمية أو غيرها من الأحكام في قانون هذه الدولة؛

2. Both paragraphs (1) and (2) stipulate that the grounds for restricting the participation of suppliers and contractors in procurement proceedings are limited to those found in procurement regulations or other provisions of law of the enacting State.
2- وتنصّ الفقرتان (1) و(2) كلتاهما على أنَّ أسباب تقييد مشاركة المورِّدين والمقاولين في إجراءات الاشتراء تقتصر على تلك الواردة في لوائح الاشتراء التنظيمية أو غيرها من الأحكام القانونية السارية في الدولة المشترعة.

5. When any of the grounds in the procurement regulations or other provisions of law is invoked by the procuring entity as a justification for restricting participation in procurement proceedings, paragraph (3) requires the procuring entity to make declaration to such effect at the outset of the procurement proceedings.
5- وعندما تتذرّع الجهة المشترية بأيٍّ من الأسباب الواردة في لوائح الاشتراء التنظيمية أو الأحكام القانونية الأخرى كمسوّغ لتقييد المشاركة في إجراءات الاشتراء، فإنَّ الفقرة (3) تقتضي أن تصدر الجهة المشترية إعلانا بذلك في بداية إجراءات الاشتراء.

Foreign suppliers would generally not have any obligation to pay taxes or social security contributions in the enacting State; article 8 prohibits the procuring entity from imposing requirements other than those permitted in the procurement regulations or other provisions of law of the enacting State that would have the effect of deterring participation in the procurement proceedings by foreign suppliers or contractors.
والمورِّدون الأجانب لا يقع عليهم عموما أيُّ التزام بدفع ضرائب أو مساهمات ضمان اجتماعي في الدولة المشترعة؛ وتحظر المادة 8 على الجهة المشترية فرض اشتراطات، عدا تلك التي تسمح بها لوائح الاشتراء التنظيمية أو غيرها من الأحكام القانونية في الدولة المشترعة، من شأنها أن تثني المورِّدين أو المقاولين عن المشاركة في إجراءات الاشتراء.

The wording in paragraph (4) (authorized or required) intends therefore to encompass two situations: when the procurement regulations or other provisions of law of the enacting State provide for the discretionary power to consider the relevant criteria and when such sources mandate the procuring entity to do so.
وبناءً عليه، فإنَّ العبارة الواردة في الفقرة (4) (تأذن بذلك أو تشترطه) ترمي إلى شمول موقفين: عندما تنصّ لوائح الاشتراء التنظيمية أو غيرها من الأحكام القانونية في الدولة المشترعة على الصلاحية التقديرية للنظر في المعايير ذات الصلة، وعندما تفوِّض تلك المصادر الجهةَ المشتريةَ بأن تفعل ذلك.

The procurement regulations or other rules or guidance should not only provide for the criteria but also regulate or guide how the criteria under paragraph (4) should be applied in individual procurements to ensure that they are applied in an objective and transparent manner.
ولا يجب أن تنصّ لوائح الاشتراء التنظيمية أو غيرها من القواعد أو الإرشادات على المعايير فحسب بل ينبغي لها أيضا أن تنظّم أو توجّه الكيفية التي بها ينبغي أن تطبَّق المعايير الواردة في الفقرة (4) في فرادى عمليات الاشتراء لضمان تطبيقها على نحو موضوعي وشفّاف.

(n) " Socio-economic policies " means environmental, social, economic and other policies of this State authorized or required by the procurement regulations or other provisions of law of this State to be taken into account by the procuring entity in the procurement proceedings. (The enacting State may expand this subparagraph by providing an illustrative list of such policies.);
(ن) يعني التعبير " السياسات العامة الاجتماعية-الاقتصادية " السياسات العامة البيئية والاجتماعية والاقتصادية وغيرها من السياسات العامة لهذه الدولة التي تأذن أو تشترط لوائح الاشتراء التنظيمية أو غيرها من أحكام قانون هذه الدولة أن تضعها الجهة المشترية في الاعتبار في إجراءات الاشتراء. (يجوز للدولة المشترعة أن توسِّع نطاق هذه الفقرة الفرعية بإدراج قائمة إيضاحية بتلك السياسات العامة)؛

(2) Except when authorized or required to do so by the procurement regulations or other provisions of law of this State, the procuring entity shall establish no other requirement aimed at limiting participation of suppliers or contractors in procurement proceedings that discriminates against or among suppliers or contractors or against categories thereof.
(2) لا تَفرض الجهةُ المشترية، إذ تهدف إلى الحدّ من مشاركة المورِّدين أو المقاولين في إجراءات الاشتراء، أيَّ اشتراط أخر يمثّل تمييزاً تجاه المورِّدين أو المقاولين أو فيما بينهم، أو تجاه فئات منهم، إلاّ عندما تكون مخوّلة أو ملزمة بفعل ذلك بموجب لوائح الاشتراء التنظيمية أو بموجب أحكام أخرى من قانون هذه الدولة.
