2. As the Special Adviser noted in his report, the strengthening of the rule of law in Somalia remains the guiding principle underlying the proposal for the establishment of Somali specialized anti-piracy courts.

The consideration of specialized anti-piracy courts in this section focuses on the legal framework in each of the above jurisdictions, the current capacity to conduct piracy prosecutions, the international assistance received to date and the further assistance that would be needed for a specialized anti-piracy court.

57. In a letter to the Legal Counsel dated 5 May 2011, the Minister for Foreign Affairs and International Cooperation of Tanzania indicated that Tanzania in principle welcomes the proposal to establish an extraterritorial Somali specialized anti-piracy court.

The Council also decided to continue its consideration, as a matter of urgency and without prejudice to any further steps to ensure that pirates are held accountable, of the establishment of specialized anti-piracy courts in Somalia and other States in the region with substantial international participation and/or support.

The inaction of the Council to ensure accountability in Somalia is in sharp contrast with, for instance, Security Council initiatives on combating piracy, including by considering earlier this year the establishment of specialized Somali courts to try suspected pirates both in Somalia and in the region, including an extraterritorial Somali specialized anti-piracy court.

The present report is submitted pursuant to paragraph 16 of Security Council resolution 2015 (2011) of 24 October 2011, in which the Council decided to continue its consideration, as a matter of urgency, of the establishment of specialized anti-piracy courts in Somalia and other States in the region with substantial international participation and/or support.

In respect of each jurisdiction, the present report assesses the current capacity and international assistance received to date to conduct piracy cases and the further international assistance that would be required for a specialized anti-piracy court to conduct cases in accordance with international standards of fairness.
