Other human rights instruments, such as ILO Convention 182 concerning the Prohibition and Immediate Action for the Elimination of the Worst Forms of Child Labour and the two Optional Protocols to the Convention on the Rights of the Child, are also increasingly recognized as part of the framework of national development.

Mr. HAMMARBERG said that although the representative of Lebanon had been correct to point out that article 32 of the Convention did not specify the minimum age for children to enter employment, it did pointedly refer to the " relevant provisions of other international instruments " , which surely referred to instruments such as ILO Convention No. 138.

International standards, such as the ILO Convention concerning Vocational Rehabilitation and Employment (Disabled Persons) and the ILO National Social Protection Floors Recommendation provided relevant guidance.

63. Governments should ratify and implement existing conventions, such as ILO Convention No. 169 concerning indigenous and tribal peoples in independent countries, if they have not already done so.
63 - وينبغي للحكومات التصديق على الاتفاقيات الحالية وتنفيذها، من مثل اتفاقية منظمة العمل الدولية رقم 169 المتعلقة بالشعوب الأصلية والقبلية في البلدان المستقلة، إن لم تكن قد فعلت ذلك بعد.

82. Finally, the Committee urges States parties to adopt a rights-based approach to indigenous children based on the Convention and other relevant international standards, such as ILO Convention No. 169 and the United Nations Declaration on the Rights of Indigenous Peoples.

(c) Transnational corporations and other business enterprises shall respect the rights of local communities affected by their activities and the rights of indigenous peoples and communities consistent with international human rights standards such as ILO Convention No. 169 (Indigenous and Tribal Peoples Convention, 1989).

D. Violence in work settings 64. There are little data on violence against child workers, especially those in the informal sector. International standards, such as ILO Convention No. 138 (1973) concerning Minimum Age for Admission to Employment preclude children under the minimum age of employment from being in the workplace.

125. Many indigenous representatives underlined the importance of collective rights for indigenous peoples and reminded Governments that the preamble to the draft declaration, as well as several international instruments such as ILO Convention No. 169, had already addressed collective rights of indigenous peoples and that one of the main aims of the draft declaration was to acknowledge and promote the collective rights of indigenous peoples.
125- وأكد كثير من ممثلي السكان الأصليين أهمية الحقوق الجماعية للسكان الأصليين وذكّروا الحكومات بأن ديباجة مشروع الإعلان، فضلاً عن العديد من الصكوك الدولية، مثل اتفاقية منظمة العمل الدولية رقم 169، قد تناولت أصلاً الحقوق الجماعية للشعوب الأصلية وأن أحد الأهداف الرئيسية لمشروع الإعلان هو الإقرار بالحقوق الجماعية للشعوب الأصلية وتعزيزها.

It is supplemented by other, more specific international instruments on the protection of child labour, such as ILO Convention No. 38 concerning Minimum Age for Admission to Employment, 1973 (Act No. 5594 of 21 October 1974, ratified on 11 June 1976) and ILO Convention No. 82 concerning the Prohibition and Immediate Action for the Elimination of the Worst Forms of Child Labour (Act No. 8122).
وتُكمِّل هذه الاتفاقية صكوكٌ دوليةٌ أخرى أكثر تحديداً تتعلق بحماية عمل الأطفال، مثل اتفاقية منظمة العمل الدولية رقم 183 بشأن الحد الأدنى لسن الاستخدام، لعام 1973 (القانون رقم 5594 المؤرخ 21 تشرين الأول/أكتوبر 1974، والمصدق عليه بتاريخ 11 حزيران/يونيه 1976) واتفاقية منظمة العمل الدولية رقم 182 بشأن حظر أسوأ أشكال عمل الأطفال والإجراءات الفورية للقضاء عليها (القانون رقم 8122).

38. A second constraint is the weak regulatory framework, which leads to a range of problems: irresponsible behaviour by employers; lack of enforcement of core labour standards -- thus undermining the ability of the trade union movement to act on these issues; the lack of ratification and implementation of basic standards such as ILO Convention No. 155 on Occupational Safety and Health; and weak labour inspectorates.

UNICEF suggested using mechanisms already established by other bodies, such as the ILO Convention on the Worst Forms of Child Labour (see para. 64 above), which offered a practical mechanism for inter-agency initiatives.

26- وإذ تضع اللجنة في اعتبارها أن حقوق الإنسان كافة كلٌّ لا يتجزأ، فإنها تشجع الدولة الطرف على النظر في التصديق على ما لم تصدِّق عليه بعد من معاهدات دولية لحقوق الإنسان، ولا سيما المعاهدات التي لأحكامها تبعات مباشرة على موضوع التمييز العنصري، مثل اتفاقية منظمة العمل الدولية رقم 169(1989) بشأن الشعوب الأصلية والقبلية في البلدان المستقلة.

20. Bearing in mind the indivisibility of all human rights, the Committee encourages the State party to consider ratifying those international human rights treaties which it has not yet ratified, in particular treaties the provisions of which have a direct relevance to communities that may be the subject of racial discrimination, such as the ILO Convention on the 169 (1989) concerning Indigenous and Tribal Peoples in Independent Countries.
20- واللجنة إذ تضع في اعتبارها عدم قابلية حقوق الإنسان جميعها للتجزئة، تشجع الدولة الطرف على النظر في التصديق على المعاهدات الدولية لحقوق الإنسان التي لم تصدق عليها بعد، لا سيما المعاهدات التي تتصل أحكامها على نحو مباشر بالجماعات التي قد تتعرض للتمييز العنصري، مثل اتفاقية منظمة العمل الدولية رقم 169(1989) بشأن الشعوب الأصلية والقبلية في البلدان المستقلة.
