In other words, in order for the Convention to be applicable, it must be possible for the State to recognize the rights guaranteed under the Convention; however, the existence of a stable juridical link such as nationality, residence or domicile is not required, as it is enough for the State to be able to exercise a degree of authority over the person concerned.
