I. Jurisdiction of United Nations Dispute Tribunal

Thus, the Panel recommends the establishment of a two-tiered system comprising a first-instance decentralized tribunal, the United Nations Dispute Tribunal, to be created by resolution of the General Assembly and composed of professional judges with power to make binding decisions.

142. To ensure that the new formal system is functioning by 1 January 2008, it is essential to establish the Internal Justice Council at an early date so that it can compile lists of candidates for the timely appointment of United Nations Dispute Tribunal judges and the filling of any vacancies that occur within UNAT.

(a) Judge (D-1) for the UNRWA Dispute Tribunal would hear and pass judgement on applications submitted to the Dispute Tribunal with regard to (i) administrative decisions alleged to be in non-compliance with the terms of appointment or the contract of employment; or (ii) administrative decisions imposing a disciplinary measure.

47. The Redesign Panel recommends that an Internal Justice Council be established to compile lists of candidates for appointment as judges of the United Nations Dispute Tribunal by the Secretary-General and the United Nations Appeals Tribunal by the General Assembly, as well as to monitor the system (see A/61/205, paras. 173 and 174).

Her delegation also supported the establishment of a first-instance tribunal, the United Nations Dispute Tribunal, which could issue binding decisions subject to appeal, and it agreed that the cases before the Dispute Tribunal should be heard by a panel of three judges to reflect the multicultural nature of the United Nations and to foster the perception of justice, impartiality, fairness and transparency.
