2. Recalling that the development of space science and technology applied in the utilization of the geostationary satellite orbit is of fundamental importance for the economic, social and cultural development of the peoples of all States;

6. Reaffirming the need to guarantee to all States in practice equitable access to the geostationary satellite orbit, in accordance with article 33 of the Nairobi International Telecommunication Union Convention;

The Working Group had also reviewed the working paper on the geostationary satellite orbit introduced at the 1993 session, and COPUOS had noted that the exchange of views on it had been productive and that its sponsor intended to submit a revised version at the 1996 session of the Legal Subcommittee.

24. At the commencement of the debate, the delegation of Colombia circulated a working paper entitled " Geostationary satellite orbit " (A/AC.105/C.2/L.192), which is set out in section A of annex IV to the report of the Subcommittee.

4. Agreeing with the fact that the geostationary satellite orbit is a geometric locus in outer space where, inter alia, an object in orbit behaves differently with respect to the Earth from the way in which it would behave in any other locus in outer space, that is, it revolves at the same speed as the Earth, for which reason, viewed from the Earth, it seems to be fixed;

As for the geostationary orbit, the Working Group conducted a paragraph-by-paragraph review of the working paper entitled " Geostationary satellite orbit " , contained in document A/AC.105/C.2/L.192, which was introduced at its 1993 session.

2. Mr. REY (Colombia) said that his delegation wished to submit formally to the Legal Subcommittee a proposal on the geostationary satellite orbit which reflected views expressed at the current session of the Committee on the Peaceful Uses of Outer Space.
٢ - السيد راي )كولومبيا(: قال إن وفد بلده يود أن يقدم رسميا الى اللجنة الفرعية القانونية وثيقة بشأن موضوع مدار السواتل الثابت بالنسبة لﻷرض تأخذ في الاعتبار اﻵراء المبداة أثناء الدورة الحالية للجنة استخدام الفضاء الخارجي في اﻷغراض السلمية.

The first part was a preamble in which, inter alia, the geostationary satellite orbit was acknowledged to be a limited natural resource which, accordingly, must be used rationally and equitably for the benefit of mankind as a whole, taking into account the special needs of the developing countries, in accordance with the provisions of the relevant international treaties on telecommunications.
الجزء اﻷول عبارة عن ديباجة يسلم فيها بجملة أمور من بينها أن مدار السواتل الثابت بالنسبة لﻷرض هو مورد طبيعي محدود وبالتالي ينبغي استخدامه بطريقة رشيدة وعادلة ولصالح البشرية جمعاء، مع مراعاة الاحتياجات الخاصة للبلدان النامية، وفقا لما هو منصوص عليه في المعاهدات الدولية للاتصالات السلكية واللاسلكية ذات الصلة.

On the issue of the geostationary orbit, the Committee had noted the constructive exchange of views on the ideas contained in the working paper " Some considerations concerning the utilization of the geostationary satellite orbit " (A/AC.105/C.2/L.200 and Corr.1).
١٢ - واسترسل قائلا إنه فيما يتعلق بمسألة المدار الثابت بالنسبة لﻷرض، نوهت اللجنة بتبادل اﻵراء البناء الذي جرى حول اﻷفكار الموضحة في ورقة العمل المعنونة " بعض الاعتبارات المتعلقة باستخدام مدار السواتل الثابت بالنسبة لﻷرض )A/AC.105/C.2/L.200 و Corr.1(.

In 1988 Colombia had first submitted a new proposal on the geostationary satellite orbit and in 1991 had drafted a non-paper, endorsed by the Group of 77, which had been circulated to members of the Subcommittee and subsequently reflected in its reports. The proposal now being formally introduced derived from that non-paper.
٣ - ومضى يقول إن كولومبيا قدمت في عام ١٩٨٨ ﻷول مرة نهجا جديدا بشأن مدار السواتل الثابت بالنسبة لﻷرض، وأعدت في عام ١٩٩١ وثيقة غير رسمية أيدتها مجموعة اﻟ ٧٧ ووزعت على أعضاء اللجنة الفرعية وأصبحت تنعكس منذ ذلك التاريخ في تقارير اللجنة الفرعية واللجنة الفرعية والنص المعروض اﻵن رسميا، للنظر، مستمد من هذه الوثيقة الرسمية.

1. Recognizing that the geostationary satellite orbit is a limited natural resource and, therefore, must be used in a rational and equitable manner and for the benefit for all mankind, taking into account the special needs of the developing countries, in accordance with the relevant international telecommunication treaties (Malaga-Torremolinos, 1973; the World Administrative Radiocommunication Conference, Geneva, 1979; Nairobi, 1982; Nice, 1989);
١ - إذ تسلم بأن مدار السواتل الثابت بالنسبة لﻷرض هو مورد طبيعي محدود، وبالتالي يجب استخدامه بطريقة رشيدة وعادلة ولصالح البشرية جمعاء، مع مراعاة الاحتياجات الخاصة للبلدان النامية، وفقا لما هو منصوص عليه في المعاهدات الدولية للاتصالات السلكية واللاسلكية ذات الصلة )ملاغا - توري مولينوس، ١٩٧٣؛ المؤتمر الاداري العالمي للاتصالات اللاسلكية، جنيف، ١٩٧٩؛ نيروبي، ١٩٨٢؛ نيس، ١٩٨٩(،

The Committee noted that an exchange of views had taken place on that subject, particularly on the basis of the ideas formulated in a working paper entitled " Some considerations concerning the utilization of the geostationary satellite orbit " (A/AC.105/C.2/L.200 and Corr.1), submitted by Colombia to the Legal Subcommittee at its thirty-fifth session (A/AC.105/639, annex III, sect. A).

3. The International Telecommunication Union (ITU) guidelines for the disposal of spacecraft in the geostationary orbit (ITU-R recommendation S.1003 entitled " Environmental Protection of the Geostationary Orbit " ) recommended that the satellite orbit should be raised to no less than 300 km fixed altitude above the geostationary orbit.
3- أوصت المبادئ التوجيهية للتخلص من المركبات الفضائية في المدار الثابت بالنسبة للأرض، الصادرة عن الاتحاد الدولي للاتصالات (التوصية ITU-R S.1003 " حماية البيئة في المدار الساتلي الثابت بالنسبة للأرض " )، بأنه ينبغي رفع مدار السواتل إلى ارتفاع محدد لا يقل عن 300 كيلومتر فوق المدار الثابت بالنسبة للأرض.
