Paragraph 7 foresees that these provisions shall apply to requests pursuant to article 46 if States parties are not bound by a treaty of mutual legal assistance, and States parties are strongly encouraged to agree to apply those paragraphs in lieu of those provisions in a bilateral treaty between two States Parties.
وتنص الفقرة 7 على أنََّ تلك الأحكام تطبَّق على الطلبات المقدَّمة بمقتضى المادة 46 إذا كانت الدول الأطراف المعنية غير مرتبطة بمعاهدة لتبادل المساعدة القانونية، وتُشجَّع الدولُ الأطراف بشدّةٍ على تطبيق تلك الفقرات بدلاً من الأحكام المقابلة في معاهدة ثنائية بين دولتين طرفين.

The Cuban delegation believes that there must be respect for the principle regarding the consent of a State to be bound by a treaty, as provided for under article 11, part II, of the Vienna Convention on the Law of Treaties, of 23 May 1969.
ويعتقد الوفد الكوبي بأنه يجب أن يكون هناك احترام للمبدأ المتعلق بموافقة دولة ما أن تكون مرتبطة بمعاهدة ما، وفقاً لما جاء في المادة 11، القسم الثاني، من اتفاقية فيينا لقانون المعاهدات، المؤرخ 23 أيار/مايو 1969.
