10. Article 8 of the Montreal Protocol states: " The Parties, at their first meeting, shall consider and approve procedures and institutional mechanisms for determining non-compliance with the provisions of this Protocol and for treatment of Parties found in non-compliance " .

4. The Conference of the Parties may wish to consider the report of the Open-ended Ad hoc Working Group on article 17 and to take a decision concerning the procedures and institutional mechanisms for determining non-compliance with the provisions of the Convention and for the treatment of Parties found to be in non-compliance.
4 - قد يرغب مؤتمر الأطراف في النظر في تقرير الفريق العامل المخصص مفتوح العضوية المعني بالمادة 17 واتخاذ مقرر بشأن إجراءات وآليات مؤسسية لتحديد حالات عدم الامتثال لأحكام الاتفاقية ولكيفية معاملة الأطراف التي يثبت عدم امتثالها.

5. The Conference of the Parties may wish to consider the annex to decision RC-2/3 on the establishment of a compliance committee, which is reproduced as the annex to the present note, and to take a decision concerning the procedures and institutional mechanisms for determining noncompliance with the provisions of the Convention and for the treatment of Parties found to be in non-compliance.
