I. - Obtain information or a confession from that individual or a third party;
أولاً- الحصول على معلومات أو اعتراف من هذا الشخص أو من شخص آخر؛ أو

I. - Severe pain and suffering, whether physical or mental, in order to obtain information or a confession from the tortured individual or a third party, or to inflict punishment for an act which that individual has or is suspected of having committed;
أولاً- ألماً قاسياً أو معاناة قاسية، بدنية أو عقلية، من أجل الحصول على معلومات أو اعتراف من الشخص الواقع تحت التعذيب أو من أي شخص آخر، أو إيقاع عقاب عن فعل ارتكبه هذا الشخص أو يشتبه في أنه ارتكبه؛

The first part of the article is designed to deprive the practice of torture of any value when inflicted on a person for such purposes as obtaining from him/her or a third person information or a confession.

Colima Article 3. - A public servant commits the offence of torture if, on account of or in exercise of their official functions, they inflict severe pain or suffering on an individual, or harm their physical and/or mental integrity, in order to obtain from the tortured individual or a third party information or a confession or to coerce them into engaging or not engaging in a specific act.

Torture was defined therein as any act by which severe pain or suffering, whether physical, mental or pharmacological, was intentionally inflicted by, or at the instigation of, or with the consent or acquiescence of a public official or other person acting in an official capacity, for such purposes as obtaining information or a confession, punishment, intimidation or coercion.

On 14 August 2001, the DPP responded that he found no basis for initiating such an investigation as, in his opinion, " there is no basis for believing that the pre-trial detention in solitary confinement was effected for the purpose of obtaining information or a confession from the person charged or a third party, making it an act of torture as defined in the Convention against Torture " .

When solitary confinement is used intentionally during pretrial detention as a technique for the purpose of obtaining information or a confession, it amounts to torture as defined in article 1 or to cruel, inhuman or degrading treatment or punishment under article 16 of the Convention against Torture, and to a breach of article 7 of the International Covenant on Civil and Political Rights.
