91. [The prohibition of the dissemination of all ideas based upon racial superiority or hatred is compatible with the right to freedom of opinion and expression.
91- [إن حظر نشر جميع الأفكار القائمة على التفوق العنصري أو الكراهية العنصرية يتفق مع الحق في حرية الرأي والتعبير.

The Committee reminds the State party that in its opinion, prohibition of the dissemination of all ideas based upon racial superiority or hatred is compatible with the right to freedom of opinion and expression.
وتذكّر اللجنة الدولة الطرف بأنها ترى أن حظر نشر جميع الأفكار التي تقوم على التفوق العنصري أو الكراهية العنصرية هو أمر يتمشى مع الحق في حرية الرأي والتعبير.

He described five premises on which he based his position, namely, from the perspectives of commitment and prioritization, new actors, legality and form, added value and the compatibility with the right to freedom of opinion and expression and the right to freedom of peaceful assembly and association.

4. In the opinion of the Committee, the prohibition of the dissemination of all ideas based upon racial superiority or hatred is compatible with the right to freedom of opinion and expression.
4- وفي رأي اللجنة أن حظر نشر جميع الأفكار القائمة على التفوق العنصري أو الكراهية العنصرية إنما ينسجم مع الحق في حرية الرأي والتعبير.

In this regard, the Committee wishes to reiterate that the prohibition of all ideas based on racial superiority or hatred is compatible with the right to freedom of opinion and expression, given that the exercise of this right carries special duties and responsibilities, including the obligation not to disseminate racist ideas.
وفي هذا الصدد، تود اللجنة أن تؤكد من جديد أن حظر جميع الأفكار القائمة على التفوق العنصري أو الكراهية العنصرية يتفق مع الحق في حرية الرأي والتعبير، نظراً لأن ممارسة هذا الحق ينطوي على واجبات ومسؤوليات خاصة، منها الالتزام بعدم نشر أفكار عنصرية.

4. In the opinion of the Committee, the prohibition of the dissemination of all ideas based upon racial superiority or hatred is compatible with the right to freedom of opinion and expression.
٤- وفي رأي اللجنة أن حظر نشر جميع اﻷفكار القائمة على التفوق العنصري أو الكراهية العنصرية إنما ينسجم مع الحق في حرية الرأي والتعبير.

In this connection, the Committee also draws the attention of the State party to its general recommendation VII and general recommendation XV, affirming the compatibility of the prohibition of the dissemination of ideas based upon racial superiority or hatred with the right to freedom of opinion and expression.
وفي هذا الصدد، تسترعي اللجنة أيضاً اهتمام الدولة الطرف إلى توصيتيها العامتين السابعة والخامسة عشرة بشأن توافق الحظر المفروض على نشر الأفكار القائمة على التفوق العرقي أو الكراهية، مع الحق في حرية الرأي والتعبير.

In this connection, the Committee also draws the attention of the State party to its general recommendations VII and XV on the compatibility of the prohibition of the dissemination of ideas based upon racial superiority or hatred with the right to freedom of opinion and expression.
وفي هذا الصدد، تسترعي اللجنة أيضاً اهتمام الدولة الطرف إلى توصيتيها العامتين السابعة والخامسة عشرة بشأن توافق حظر نشر الأفكار القائمة على التفوق العرقي أو الكراهية العرقية مع الحق في حرية الرأي والتعبير.

In this regard the Committee recalls its general recommendations VII and XV, according to which the prohibition of dissemination of all ideas based upon racial superiority or hatred is compatible with the right to freedom of opinion and expression, given that a citizen's exercise of this right carries special duties and responsibilities, among which is the obligation not to disseminate racist ideas.
وبهذا الخصوص، تشير اللجنة إلى توصيتيها العامتين السابعة والخامسة عشرة اللتين جاء فيهما أن حظر بث جميع الأفكار التي تقوم على التفوق العرقي أو الكراهية العرقية يتماشى مع الحق في حرية الرأي والتعبير، علماً بأن ممارسة المواطن لهذا الحق تستتبع واجبات ومسؤوليات محددة من بينها واجب عدم بث أفكار عنصرية.

4. In the opinion of the Committee, the prohibition of the dissemination of all ideas based upon racial superiority or hatred is compatible with the right to freedom of opinion and expression.
٤ - وفي رأي اللجنة أن حظر نشر جميع اﻷفكار القائمة على التفوق أو الكراهية العنصريين إنما ينسجم مع الحق في حرية الرأي والتعبير.

4. In the opinion of the Committee, the prohibition of the dissemination of all ideas based upon racial superiority or hatred is compatible with the right to freedom of opinion and expression.
4- ورأي اللجنة أن حظر نشر جميع الأفكار القائمة على التفوق العنصري أو الكراهية العنصرية إنما ينسجم مع الحق في حرية الرأي والتعبير.

" 16. Notes that the Committee holds that the prohibition of the dissemination of ideas based on racial superiority or racial hatred is compatible with the right to freedom of opinion and expression as outlined in article 19 of the Universal Declaration of Human Rights and in article 5 of the Convention;
" 16 - تلاحظ أن اللجنة قد خلصت إلى أن حظر نشر الأفكار القائمة على التفوق العنصري أو الكراهية العنصرية يتوافق مع الحق في حرية الرأي والتعبير على النحو المبين في المادة 19 من الإعلان العالمي لحقوق الإنسان وفي المادة 5 من الاتفاقية؛

19. Notes that the Committee holds that the prohibition of the dissemination of ideas based on racial superiority or racial hatred is compatible with the right to freedom of opinion and expression as outlined in article 19 of the Universal Declaration of Human Rights and in article 5 of the Convention;
19 - تلاحظ أن اللجنة قد خلصت إلى أن حظر نشر الأفكار القائمة على التفوق العنصري أو الكراهية العنصرية يتوافق مع الحق في حرية الرأي والتعبير على النحو المبين في المادة 19 من الإعلان العالمي لحقوق الإنسان وفي المادة 5 من الاتفاقية؛

12. The text in particular recalled general recommendation XV (42) of the Committee on the Elimination of Racial Discrimination according to which prohibition of the dissemination of all ideas based on racial superiority or racial hatred was compatible with the right to freedom of opinion and expression.
12 - وذكرت أن نص مشروع القرار يشير بوجه خاص إلى التوصية العامة الخامسة عشرة (42) للجنة القضاء على التمييز العنصري التي تفيد بأن حظر نشر كل الأفكار القائمة على التفوق العنصري أو الكراهية العنصرية لا يتعارض مع الحق في حرية الرأي والتعبير.

The Committee also clearly stated that in its opinion, " the prohibition of the dissemination of all ideas based upon racial superiority or hatred is compatible with the right to freedom of opinion and expression " .
وذكرت اللجنة بوضوح أيضاً أنها ترى أن " حظر نشر جميع الأفكار القائمة على التفوق العنصري أو الكراهية العنصرية إنما ينسجم مع الحق في حرية الرأي والتعبير " (7).
