The members of the Security Council therefore intend to request from President Pillay a written undertaking to be fully available as a judge of the Tribunal for Rwanda, as required by paragraph 3 of article 12 bis of the Tribunal's Statute.

The Security Council has not responded to this report, which was made pursuant to rule 7 bis of the Tribunal's Rules of Procedure and Evidence. Moreover, I reported the failure of the Federal Republic of Yugoslavia to recognize the Tribunal's jurisdiction over alleged offences committed in Kosovo.

4. Two of the permanent judges of the International Tribunal for Rwanda elected or appointed in accordance with article 12 bis of the Statute of that Tribunal shall be assigned by the President of that Tribunal, in consultation with the President of the International Tribunal, to be members of the Appeals Chamber and permanent judges of the International Tribunal.
