" 189. The law should provide that a retention-of-title or financial lessor's right in tangible property other than inventory or consumer goods is effective against third parties only if:

`4` حقا بمقتضى أي ترتيب يمكِّن الدائن الذي قدّم الائتمان من أجل تمكين شخص من احتياز ممتلكات ملموسة غير الصكوك القابلة للتداول أو المستندات القابلة للتداول أو استخدامها من الاحتفاظ بالحق في أن يصبح المالك النهائي للممتلكات بحيث يُستوفى التزام السداد؛

(iii) The retained ownership and related rights arising under any arrangement that enables a person to acquire possession or use of tangible property other than negotiable instruments or negotiable documents and whereby pursuant to the arrangement title to that property does not vest irrevocably in the person possessing or using the property until or under the condition that the price is paid; and
`3` حق الملكية المحتفظ به وما يتصل به من حقوق محتفظ بها وناشئة عن أي ترتيب يمكِّن شخصا ما من احتياز أو استخدام ممتلكات ملموسة غير الصكوك القابلة للتداول أو المستندات القابلة للتداول ولا يؤول فيها حق ملكية تلك الممتلكات بشكل لا رجوع فيه، بمقتضى ذلك الترتيب، إلى الشخص الذي يمتلك تلك الممتلكات أو يستخدمها إلى أن يُسدد ثمنها أو بشرط تسديد ثمنها؛

(f) " Acquisition security right " , in the context of both the unitary and the non-unitary approach to acquisition financing rights, means a security right in tangible property other than negotiable instruments or negotiable documents that secures the obligation to pay any unpaid portion of the purchase price of the property or an obligation incurred or credit otherwise provided to enable the grantor to acquire the property.
(ع) " الحق الضماني الاحتيازي " ، في سياق كلا النهجين الوحدوي وغير الوحدوي إزاء حقوق تمويل الاحتياز، يعني حقا ضمانيا في ممتلكات ملموسة غير الصكوك القابلة للتداول أو المستندات القابلة للتداول يضمن الالتزام بسداد أي جزء لم يسدّد من ثمن شراء الممتلكات أو يضمن التزاما آخر معقودا أو ائتمانا مقدَّما لتمكين المانح من احتياز الممتلكات.
